En Côte d’Ivoire comme dans d’autres pays africain, le pluralisme juridique est l’origine d’une crise de la légalité et de crispations sociales. L’accès à la terre est emblématique des difficultés et des différends qui peuvent naître de la coexistence, issue de la colonisation, d’une pluralité de modes de normativité étatique et coutumier en jeu sur un même territoire.

Ce guide aborde la question de l’enregistrement des droits fonciers, en mettant l’accent sur la création d’un nouveau système pour enregistrer lesdits droits et sur le fait de les enregistrer dans un système pour la première fois. Si des systèmes d’enregistrement existent déjà à travers le monde, il arrive souvent que les populations n’y ont pas accès pour enregistrer leurs droits fonciers. Ce guide traite des situations où l’approche la plus indiquée est de créer un nouveau système pour enregis trer ces droits.

This guide is about extending the recording or registration of tenure rights to people who currently are not served by systems to record their rights. It provides practical advice on ways to introduce a new system to record tenure rights and for the recording of rights for the first time by the state, a process that is sometimes called first registration.

This paper studies the impact of land tenure on household agricultural productivity in Benin. Compared to households without land ownership or right to land (squatters), results show that land certificate ownership increases by 0.238 the likelihood of investing in agricultural equipment, whereas customary law ownership increases this likelihood by 0.374. The study suggests that public authorities recognise customary rights and reinforce legal land institutions.

From January 15 to February 6, 2018, the USAID’s Tenure and Global Climate Change Program and Land Portal Foundation co-facilitated a dialogue on experiences of documenting household and community-level customary rights in Zambia. The dialogue brought together the perspectives of government, traditional leaders, practitioners, civil society, and academics to consider how customary land documentation can contribute to national development goals and increased service delivery in rural and peri-urban areas.

En la presente guía se aborda el registro de los derechos de tenencia haciendo especial hincapié en mejorar las formas existentes de registrar derechos. Si bien existen numerosos sistemas de registro en todo el mundo que ayudan a lograr la seguridad de la tenencia y brindar otras ventajas a los titulares de derechos de tenencia, también hay muchos sistemas que no funcionan bien y pueden ponerse obstáculos sin quererlo o de forma deliberada para evitar que las personas usen dichos sistemas.

FAO and the Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH have been providing support to the Western Balkans region to promote progress on Gender Equality, with a focus on measuring the proportion of countries where the legal framework guarantees women’s equal rights to land ownership and/or control.

The Land Portal Foundation, Landesa and the Sustainable Development Institute (SDI) co-facilitated a discussion on Liberia’s Land Rights Bill between July 18 and August 8, 2018. The discussion took place in collaboration with the Rights & Rice Foundation, Habitat for Humanity, and the Land Rights Now campaign.

The webinar on the Land Reform Agenda for Kenya took place on 10 October, 2018. The webinar reviewed the land reform process in Kenya and addressed a range of challenges, with a view to defining a path forward that will lead to equity and justice in land reforms.
