This Ministerial Decree sets forth the modalities for the accurate determination and mapping of the effective position of coastlines. The crossline between the surface of surface waterbodies (seas, lakes, rivers, ponds and water reservoirs) and the surface of dry land shall be established depending upon the determined water edge. Effective position of sea coastline shall be established at the maximum level of high tide and in the absence of such phenomenon in accordance with the surf line.

These Regulations correct two errors in the principal Regulations. They remove an erroneous reference in regulation 3 of the principal Regulations and they correct the provision relating to fines in regulation 21(2) of those Regulations in accordance with the terminology used for offences which are summary only.

L’article 1er établit que la liste des activités à risque au sens de l'article 3, 3°, de l'ordonnance du 5 mars 2009 relative à la gestion et à l'assainissement des sols pollués est fixée conformément à l'annexe au présent arrêté. L’article 2 spécifie que les installations classées temporaires au sens de l'ordonnance du 5 juin 1997 relative aux permis d'environnement qui ont fait l'objet de l'octroi d'un permis d'environnement ne sont pas considérées comme des activités à risque.

This Decree states that the Ministry of Emergency Situations and the Ministry of Ecology and Natural Resources shall be charged with making a survey of the areas under risk of landslides in Baku and Absheron peninsula and producing maps to determine the geographic coordinates of these areas. The local authorities shall ensure the coordination with the Ministry of Emergency Situations and the Ministry of Ecology and Natural Resources to approve the construction projects in these areas in accordance with the Article 75.4 of the Code of Urban Planning and Construction.

Article 10 shall be amended to add the following wording: “the offender shall be obliged to restore land plot to the former state with compensation of the damages caused to landowner”.
