The notion that the formal titling and individualization of land rights in developing countries lead to higher investments in land and agricultural productivity holds sway in academic and development circles. In this paper, this notion is analyzed based on a comparative study of land reform programs and their implications for access to land, credit, and agricultural investments in Ghana, Kenya, and Vietnam. It focuses on how different access routes to land influence access to credit, and the transaction costs of land reform programs for agricultural investments.

This report for public comment presents and analyses key issues arising from extensive interviews
conducted with workers on and off farm, individual employers, representatives of organised
agriculture, trade unions, NGOs, worker support organisations, municipal councillors and officials
together with representatives from provincial government departments. It sets out options for a
strategy to address farm worker housing and related needs.

In this case, which was  heard before the Constitutional Court of the Republic of South Africa, The Restitution of Land Rights Amendment  Act 15 of 2014  was declared invalid. The Act, among other things, sought to extend the period in which land restitution claims could be  lodged. The author looks at the past 22 years of land reform in South Africa. What is going wrong in South Africa’s post-apartheid land reform programme, and how can its failings be addressed? 22 years after the transition to democracy and the commencement of land reform, there is a great deal of lived experience to reflect upon and a rich literature to draw on. He offers a diagnosis of failures, suggest a new narrative for land reform, and offers some provocations around alternative policies.
