These Regulations amend the European Union (Good Agricultural Practice for Protection of Waters) Regulations 2014 so as to give effect to the Commission Implementing Decision on granting a derogation requested by Ireland pursuant to Council Directive 91/676/EEC concerning the protection of waters against pollution caused by nitrates from agricultural sources. They also make technical amendments to sections 17 and 26 of the principal Regulations and insert a new Part (7) on implementation of the Commission Decision.

These Regulations provide, for purposes of implementation of the give effect to Irelands Third Nitrates Action Programme, rules relative to good agricultural practice to protect waters against pollution from agricultural sources and prescribe measures for these purposes, including: periods when land application of fertilizers is prohibited; limits on the land application of fertilizers; storage requirements for livestock manure; and monitoring of the effectiveness of the measures in terms of agricultural practice and impact on water quality.

These Regulations designate a coastal area as a Special Protection Area in accordance with Article 4 of Directive 2009/147/EC of the European Parliament and of the Council on the Conservation of Wild Birds. The purpose is to ensure protection from disturbance, capture and damage to nests and eggs under Article 5 of the Directive for all species of birds, not just the birds listed on Schedule 3 (with the exception of those birds covered under Articles 7 for hunting and 9, where derogations are listed).

This Decree of the Ministry of Agriculture, which is composed of 12 articles and five Annexes, implements the relevant regulations of the European Union and lays down the way of: (a) storage of fertilizers and excipients and capacity of storage space; (b) the use of fertilizers and excipients on agricultural land and forest land; (c) keeping records on the use of fertilizers, excipients and treated sludge; (d) reporting on the use of treated sludge. The provisions of Order No. 94 give the Danish AgriFish Agency the responsibility of granting subsidies to owners and tenants of farms in order to convert agricultural land to organic farming. This Order partially amends this Order, in particular its introduction, whereby the implementation of Rural Development Act (No. 316 of 2007) provisions are now changed to articles 3, 5 (sect. 1-3) art. 7 (sect. 4) art. 11 (sect. 4), and pursuant to 5, sect. 1, No. 5 of Order No. 559 on the Danish AgriFish Agency's duties and powers.

The Order is intended to contribute to the sustainable development of rural areas through the promotion of stronger competitiveness in agriculture, food and forestry sectors. Its purpose is to protect the environment by granting subsidies to sustainable measures aimed to improve agricultural production and agricultural product qualities (Natura2000 planning). The Ministry of Food, Agriculture and Fisheries and the Ministry of Housing, Urban and Rural Affairs shall, within their respective responsibility areas, set rules on the granting of financial aid.

This Order establishes additional provisions related to the Farms Act. A farm/land property can be registered as such and notification thereof shall be submitted to the Survey and Cadastre Authorities to ensure proper residency status. Provisions also include companies in other EU countries or countries that have signed the Agreement on the European Economic Area (EEA). It is compulsory that these companies are registered with a branch office operation.
