This Law regulates relations concerning ownership, land tenure, and disposal of agricultural land, establishing plenary powers of regional administration and local government in the sphere of turnover of agricultural land. It establishes terms and conditions for allotment of plots of agricultural land pertaining to state and municipal property. Agricultural land shall be used exclusively for agricultural production.

Esta publicación compartida por la FAO y Naciones Unidas-Hábitat trata de comprender y definir mejor los procesos, los mecanismos y las instituciones de la gobernanza de la tenencia en áreas rurales y urbanas. En el documento se reconoce que se han realizado excelentes políticas de la tierra, leyes y reformas técnicas. Sin embargo, su implementación en muchos casos ha sido errónea, ha sufrido retrasos o, incluso, se ha invertido.

Les achats de terres agricoles par des étrangers, en Afrique et ailleurs, sont devenus un motif d’inquiétude. De nombreux observateurs considèrent qu’ils équivalent à une forme moderne de colonialisme et qu’ils menacent la sécurité alimentaire des populations pauvres. Cependant, les investissements pourraient avoir des conséquences positives si les objectifs des acheteurs de terres et les besoins en matière d’investissements des pays en développement étaient réconciliés.

Foreign acquisitions of farmland in Africa and elsewhere have become the focus of concern. Many observers consider them a new form of colonialism that threatens food security of the poor. However, investments could be good news if the objectives of land purchasers are reconciled with the investment needs of developing countries.

FAO (Food and Agriculture Organization of the United Nations), GTZ (Gesellschaft für Technische Zusammenarbeit) and other development partners are working together with countries to prepare Voluntary Guidelines that will provide practical guidance to states, civil society, the private sector, donors and development specialists on the responsible governance of tenure.

Land Tenure Working Paper 11. This co-publication of FAO and UN-HABITAT seeks to better understand and define the processes, mechanisms and institutions of governance of tenure in rural and urban areas. The paper recognises that excellent land policies, laws and technical reforms have been developed. However, in many cases their implementation has slipped, stalled or even been reversed. By adopting a governance and political economy perspective, the paper offers insights for the design of reforms and for the development of land governance tools.

The articles in this volume supplement FAO Land Tenure Studies 10, Compulsory acquisition of land and compensation. The latter publication explains what compulsory acquisition and compensation are and what constitutes good practice in this area. This current volumes introductory article provides an overview of these issues. The issue of compulsory acquisition from a human rights perspective is also addressed here as are the concepts of market value, compensation value and just terms compensation.
