Rotuma Lands Act.

This Act provides for various aspects relative to dealings in land in Rotuma and provides for the appointment of the Rotuma Lands Commission. The Commission shall ascertain (traditional) land rights, resolve disputes relative to land rights, demarcate land and register land rights (sect. 4). All land found by the Commission to be un-owned shall vest in the Crown in trust for the Rotuman people, but shall not be considered to be Crown land. All moneys derived from such un-owned land shall be paid into the Rotuman Development Fund and be used for the purposes of that Fund.

The purpose of this Law is to clarify the ownership of property and to protect property rights including rights relating to land.This Law shall apply to civil relationship arising from the ownership and utilization of property including movable and real property. Real or movable property may be owned jointly by two or more institutions or individuals and may be of two kinds, namely co-ownership by proportion and common ownership. Registration shall be granted for the establishment, modification, transfer and lapse of the right in real property by the registration department.

The present Law introduces some amendments to the Tyrol Farmland Requirement Law 1996 (LGBl. No. 74). In particular, the Law adds a paragraph 5 to article 33 dealing with the intrinsic value of an agricultural community plots; furthermore, the text amends, inter alia, article 40 concerning issuing of building authorization on behalf of the competent authority. This Chapter defines certain rights and owners of real property and tenants for life. The owner of a life estate may use the land in the same manner as the owner of a fee simple, except that he or she must do no act to the injury of the inheritance. Sections 2 and 3 of Article 1 define property rights of a Tenants for Years. Section 6 defines rights of lessees and assignees against his immediate lessor, for the breach of any agreement in the lease.
