This Order, made bu the Department of the Environment in exercise of the powers conferred by section 32 of the Planning Act (Northern Ireland) 2011, grants planning permission in respect of certain development which is necessary for the purposes of housing poultry and other captive birds to protect them from avian influenza. The Order applies to land within a controlled zone, H5N1 controlled zone, wild bird control area or wild bird monitoring area declared by the Department of Agriculture and Rural Development and to any identified premises.

These Regulations prescribe the bodies the Department must consult for the purposes of section 104(5)(b) of the Planning Act (Northern Ireland) 2011 before making a conservation area designation. These bodies are, for the purposes of these Regulations, the Department of the Environment, the Department for Regional Development and any water or sewerage undertaker. They also prescribe bodies that must be consulted before varying or cancelling a conservation area designation (the council concerned, the Department for Regional Development and any water or sewerage undertaker).

Item 8 shall be amended to add the following wording: “Transfer of land of protected areas shall be performed after positive conclusion of environmental audit based on technical and economic substantiation and after public hearing on the issue”.

This Notice of the Minister of Water and Environmental Affairs, made under section 19 of the National Environmental Management: Waste Act, 2008, provides norms and standards for the control of the extraction, flaring or recovery of landfill gas at facilities as described in paragraph 4. The standards and norms concern, among other things: planning, design and construction of the facility, operations, management of emergency situations and decommissioning of facilities. The standards also contain monitoring and reporting requirements.

This Decree shall be applied to procedures, legal transactions, legal relations in connection with the utilization of land parcels of the National Land Fund, and to natural persons, legal entities and entities without legal personality taking part in such affairs.

The Order partly amends Order No. 94, in particular the deadline and means for applying for subsidy – whereby the application must be submitted electronically and in adherence to Commission Delegated Regulation (EU) No. 640/2014 of 11 March 2014. The Order repeals articles 25, 25a-25f, 30 and 39. A new Chapter (6a) is inserted and provides rules on the decrease of subsidy in adherence to article 35 of Commission Regulation No. 640/2014 of 11 March 2014. There will be no payment of subsidies for areas mentioned in article 32, section 2b of Regulation (EU) No. 1307/2013.

The present Ordinance lays down provisions relating to the distribution of competencies among the various bodies dealing with waste and soil protections issues. The Annex lays down in details authorities competent for specific administrative services renders, such as, for example, finding adequate places to stock waste, authorizing the building and functioning of such a deposit, transfer of waste management and waste disposal to third parties. The text consists of 5 articles and 1 Annex.

The present Ordinance lays down provisions relating to the granting of financial contributions for the conservation of natural flora in the Canton of Appenzell Inner-Rhoden and establishes measures relating to biological qualities of plots of land.
