This Act applies to physical planning within a Physical Planning Area declared as such by a Municipal Council or Local Government Council. In declaring an area to be a Physical Planning Area, a Council may in its absolute discretion decide that one or more of the types of development specified in Schedule I shall not require permission for development, and it shall specify those types of development in the declaration. Whenever a council declares an area to be a Physical Planning Area it shall prepare a plan of that area.

This Act provides for town and country planning at various levels of administration.The Act provides for the establishment of a National Physical Planning Council and of a State Planning Committee which shall promote, regulate, control and advise on, the use and development of all lands in the State. The Council may form time to time establish a regional planning committee.The State Director shall make a development plan based on the review of existing developments in the State.

This Regional Law regulates management and protection of land as a basis for vital activity of the population. Regional administration shall have the following competence in the sphere of land relations: (a) enforcement of the federal land legislation; (b) expropriation, including bailout, of plots of land for public needs; (c) elaboration and realization of regional programs for land conservation; (d) management and disposal of land plots pertaining to regional property; and (e) other plenary powers not pertaining to federal bodies or local government.

This Presidential Decree validates rates of payment for timber extraction in public forests and rate of payment for citizens extracting timber in accordance with purchase and sale contract of forest species. In case of cleaning cutting, referring to cutting of dead or damaged standing timber rate of payment shall be reduced by 50 percent and in other types of cleaning cutting rate of payment shall be reduced by 30 percent. Rate of payment includes land tax.

Regional Law No. 303 "On protected areas".

This Regional Law shall be applicable to all categories of protected areas of regional significance constituted either with expropriation of land areas from land owners or without it. Conservation and management of protected areas shall be based upon the following principles: (a) priority of conservation of protected areas with regard to management thereof; (b) priority of management of protected areas for scientific research purposes; (c) prohibition of any economic activity incompatible with the regime of protected areas.

The present Law implements the Federal Water Association Act of 12 February 1991 (BGBl. I p. 405). In preparing the budget, the Associations must comply with the principles of efficiency and economy. The budget must include all incomes and expenses anticipated in the relevant financial year. For greater investments over several years, an appropriate plan has to be made. The text consists of 16 articles divided into 4 Parts as follows: Budget, accounting and inspections (1); Public announcements of the competent authority (2); Water charges (3); Dissolution of existing associations (4).

Regional Law No. 76-ZKO “On land-use planning”.

This Regional Law regulates relations in the sphere of land-use planning and issuance of authorization for construction. Land-use planning shall take into consideration ecological factors with a view of ensuring sustainable development of the territories. In case of absence of land-use planning documentation local government shall not be allowed land reservation, expropriation or transfer of land from one category to another. Land-use planning documentation shall contain mapping of the territory, including mapping of the boundaries of protected areas and mapping of agricultural land.

This Regional Law establishes jurisdictional competence of regional and local executive bodies in the sphere of land tenure related to land areas state ownership of which is undelimited. This Law provides conditions by which compensation for restrictions on economic activities in protected territories established by the State or local governments shall be granted and the procedures for granting such compensation. Compensation granted for restrictions on economic activities in protected territories shall be divided as follows: (a) reimbursement; and (b) exchange of a land parcel situated in a protected territory to an equivalent land parcel owned by the State or local government.

This Act makes provision with respect to the promotion of prudent, effective and efficient management in Executive Agencies and the provision of appropriate mechanisms for proper management, accountability and transparency in the operations of Executive Agency. Executive agencies are public bodies designated by the Minister. Bodies designated as Executive Agencies include: the Management Institute for National Development; the National Environment and Planning Agency; and the National Land Agency. Every Executive Agency shall have its management scheme as set out in this Act.
