This Act sets out the legal, administrative and procedural framework for determining land title in British Columbia.
Land Survey Act ([RSBC 1996] Chapter 247).
This Act creates a framework for land surveyal by British Columbia government surveyors. It is divided into 3 Parts and 15 sections as follows. Official Surveys (Part 1): boundaries and monuments placed by government are true ones (sect. 1); parcels to comprise all width included within their boundaries (sect. 2); division lines joining corresponding posts (sect. 3); construction of grant of aliquot part (sect. 4); if original post or monument cannot be found (sect. 5); subdivisions of land surveyed in sections one mile square (sect.
Property Law Act ([RSBC 1996] Chapter 377).
This is a piece of general property legislation, regulating the transfer and disposition of property, interests and rights.
Expropriation Act ([RSBC 1996] Chapter 125).
This Act is divided into 7 parts as follows: Definitions and application (1); Approval (2); Pre-expropriation procedures (3); Expropriation (4); Compensation procedures (5); Basis for compensation (6); General (7).This Act regulates land expropriation by an "expropriating authority", defined as a person, including the government, empowered under an enactment to expropriate land (sect. 1).
Land Title Inquiry Act ([SBC 2004] Chapter 66).
This Act regulates land title inquiries for fee simple titles, for interests in land, or for government title to land. Inquiries may be initiated on application by the interested party to the Supreme Court in the form of a petition (sects. 1 and 2). In case of a contest of title etc., the Court may either decide on the evidence before it, direct any issue to be tried by a jury or defer the declaration until further investigation (sect. 17). A model for an order of the Court containing a declaration of title is specified in section 23.
