This Act makes provision for the devolution of legal interest in real estate on the decease of the owner to personal representatives or representative. The Act also provides for administration of the estate by the personal representatives or representative of a deceased person and transfer to heir or devisee.

This Act establishes the Port Authority for Montserrat and defines its functions and powers. The Act also makes provision with respect to compulsory acquisition of land by the Authority and defines certain rules applying to port operations and navigation in ports. Some provisions concern the storage of perishable goods.

This Act provides for sale and lease of land, and any estate or interest therein, which is the subject of a settlement. “Settlement” signifies any act, deed, agreement, will or other instrument under or by virtue of which any land or any estate or interest in land stands limited to or in trust for any persons by way of succession.

This Act makes provision for the administration of unrepresented estates (as defined) by the Administrator of Estates appointed under this Act. After receiving, upon application to Court, an order, the Administrator of Estates shall forthwith take possession and cause an inventory of the estate mentioned in such order to be made, and shall file the inventory in Court.

This Act provides for control of tenancy contracts of small holdings, i.e. parcels of land intended for cultivation or pasturage, with or without buildings thereon, consisting of not less than a quarter of an acre and not more than 25 acres. The Act provides rules relative to contracts of tenancy and provides with respect to evidence of registered contracts.

This Act makes provision for matters of inheritance by will. It specifies the procedures and criteria for the making of a will and the effect of a valid will. A general devise of testator’s lands shall include leasehold as well as freehold lands.

This Act makes provision for the protection of the foreshore. It places restrictions on the removal of sand, stones, shingle or gravel from a beach and the fouling of the seashore.

This Act provides rules relative to lease of small tenements and legal proceedings in relation with such lease. The Act defines rights and duties of landlords and tenants. “Land” in this Act shall not include a small holding within the meaning of the Agricultural Small Holdings Act.

This Act makes provision for the registration of land and related matters. It also defines certain rights relating to land and the effect of registration. The Act establishes a land register, which shall comprise a register in respect of every parcel which has been adjudicated in accordance with the Land Adjudication Act, 1978 and a register of leases required to be registered by this Act.
