La susdite recommandation consiste en 8 articles et 1 annexe énumérant des projets que doivent faire l'objet d'un échange d'informations et d'une harmonisation, dans la mesure où il relève de l'aménagement du territoire et a, ou est susceptible d'avoir, des répercussions notables sur l'espace frontalier ou une partie importante de celui-ci. Les installation liées entre elles géographiquement ou sur le plan technique sont considérées comme une seule unité.

These Regulations amend the Planning (Control of Major-Accident-Hazards) Regulations (Northern Ireland) 2009 to implement Directive 2003/105/EC of the European Parliament and of the Council amending Council Directive 96/82/EC on the control of major-accident hazards involving dangerous substances. They amend Part A (named substances) of Schedule 3 and make transitional exemptions for purposes of Article 61 of the Planning (Northern Ireland) Order 1991.

The aim pursued by this Directive is the protection of the environment against the harmful effects caused by the discharge, treatment or deposit of waste oils. For the purposes of these provisions “waste oils” shall mean any liquid or semi-liquid used products totally or partially consisting of mineral or synthetic oil, including the oily residues from tanks, oil-water mixtures and emulsions. Member States must take all necessary measures to ensure the safe collection and disposal of waste oils.

A high level of environmental protection and human health protection requires the setting and maintaining of stringent operational conditions, technical requirements and emission limit values for plants incinerating or coincinerating waste within the Community. The aim of this Directive is to prevent or reduce negative effects on the environment, particularly emissions into air, soil, surface water, as well as the resulting risks to human health which might arise from incineration and coincineration of waste.

The Regulation deals with the protection of the environment in the industrial areas referred to as Industrial parks and listed in Chapter I, Article 3. In particular, it indicates procedures for building up the infrastructures of manifacturing areas, the potential inspections by certified authorities to evaluate impact on environment, the start-up of the aforesaid areas after being cleared by the legal bodies, the processing of all wastes deriving from industrial activities.
