This Act makes provision with respect to the transcription of deeds regarding land transactions and rights and mortgages. The Act sets out the documents to be transcribe documents to be transcribed and how they are to be transcribed. Documents shall be transcribed by filing them with the Mortgage Office or the Conservator of Mortgages. The Act also provides rules for effects of mortgages and effects on mortgages of certain deeds such as sale if mortgages are not inscribed.

This Law defines the provisions regarding the land survey and the public real estate cadastre, including various administrative and technical issues, procedural matters, data collection and registration, additional mapping rules and financial aspects and requirements.The Law is divided into IX Chapters and 212 article, including the offences and related penalties.

El presente Decreto Legislativo crea el Instituto Geofísico del Perú (IGP), que es un organismo público ejecutor, adscrito al Ministerio del Ambiente (MINAM), que genera, utiliza y transfiere conocimientos e información científica y tecnológica en el campo de la geofísica y ciencias afines, y contribuye a la gestión del ambiente geofísico con énfasis en la prevención y mitigación de desastres naturales y de origen antrópico.

Persons having acquired a just and lawful right of title in derelict lands, either by prescription or by contract or in any other manner, may apply to the High Court to order the registration of such title (sect. 3). Section 4 provides for the application for the registration of land by persons entitled to "expropriate" such land. Section 5 provides for the application to the high Court for relief by persons having a claim on derelict land.

The Act provides for powers of land surveyors to carry out land survey of boundaries of estates and for procedures of such survey, the review of surveys and the inclusion of surveys in survey plans. Notice of land survey shall be given 7 days prior to survey and shall be in the form as set out in the First Schedule. A warrant of land survey shall be issued in a prescribed form by a judge if survey is carried out to establish boundaries of adjoining lands in order to resolve a land dispute (sect. 6).

The object of the Act is to provide a system for the registration of title to land and interests in land.

The present Act makes arrangements relating to lands in Forest Areas. Such lands shall be sold by the appropriate authority to peasants who have "settled down there and who have been cultivating the lands for at least one year past..." (art. 4(1)). Land left over after sale and distribution as described above shall be sold or distributed in the prescribed manner. Further provisions concern the registration of lands, the modalities for the payment of the price of the land by the allottee and enforcement measures.

L'article 3 de la loi nº 15-63 fixant le régime de la propriété foncière est ainsi complété: " les frais et droits, inhérents à la procédure d'immatriculation seront recouvrés comme en matière d'enregistrement". Le dernier alinéa de l'article 42 de la même loi est ainsi modifié: " l'inobservation de ce délai est sanctionnée par une amende civile égale, par mois de retard, à 0,2 pourcent des valeurs de transaction qui sera perçue au profit du Trésor par le Conservateur. Le montant de cette amende est limité au montant des droits simples de transcription".

This Act makes provision for the recording of certain legal deeds and patents and the effect of such recording and prescribes penalties for the selling or mortgaging of land, tenements and hereditaments twice.The Act sets out certain conditions for a transfer of any freehold or inheritance and defines the legal effect in terms of evidence of the recording of deeds at the Record Office. The Act also provides for the recording of full satisfaction obtained by a mortgagee of any lands or tenements.
