La présente loi fixe le cadre qui détermine les différents statuts des terres et pose les principes qui doivent les présider. La loi, par la suite, énumère les différents statuts des terres en donnant leur définition, consistance, régime juridique et mode de gestion. Ces statuts concernent notamment : les terres dépendant des domaines de l’Etat, des collectivités décentralisées et des autres personnes morales de droit public ; les terrains des personnes privées et les terrains constitutifs d’aires soumises à un régime juridique de protection spécifiques.

The present Act lays down provisions concerning the acquisition of immovable property by non residents, which basically shall be prohibited, except for certain circumstances under which such acquisition shall be allowed (those specified in article 5). As a general rule, A person, other than a physical or a non resident person, may acquire by an act inter vivos immovable property in Malta without the necessity of obtaining a permit under this Act where such immovable property is required for the purpose of carrying out the activity for which it has been set up.

This Regional Law regulates privatization of agricultural land in permanent (open-ended) tenancy of agricultural organizations. Citizens shall be granted the right of once-only privatization of the plots of agricultural share as common land share (art. 3). Article 4 specifies categories of citizens that have the right of privatization of the plots of agricultural land.

This Act, consisting of 25 sections, concerns the construction of dividing fences. Under section 2, a dividing fence means a fence separating the adjoining lands of different owners whether the adjoining lands are wholly or only partly separated thereby and whether the fence is on the line of or, in an appropriate case, on a line on the common boundary of the adjoining lands or on a line other than the line of or a line on the common boundary or partly on any one of those lines and partly on the other or others.

Regional Law No. 456-ZTO “On maximum and minimum areas of land plots authorized for allotment to citizens”.

This Regional Law establishes maximum and minimum areas of land plots authorized for allotment in ownership to citizens out of stock of land pertaining to state or municipal property for farming, gardening, horticulture, stockbreeding and housing construction in rural areas. Maximum areas of land plots shall be authorized for allotment once-only free of charge in ownership to some categories of citizens that have the right to such allotment in accordance with the list of categories of citizens established by federal and regional legislation.

This Regional Law establishes that in case of privatization of agricultural land due to reorganization, privatization or bankruptcy of agricultural the following categories shall have the right to allotment of land share of agricultural land free of charge: (a) workers of agricultural organizations and women on maternity leave; (b) citizens sacked by agricultural organizations dues to staff cuts after 1 January 1992; (c) retired staff of agricultural organizations; (d) disabled persons due to work in agricultural organizations; and (e) heirs of deceased workers of agricultural organizations
