The present regulations provide for the enforcement of the Commissioner’s Land Act. The regulations contain at the outset a definition clause referring to various terms therein employed, such as “Act”, “agreement for sale”, “application”, “Deputy minister”, “land agent”, “lease”, “notification”. They apply to the sale, lease or any other disposition of Commissioner’s land or any interest in Commissioner’s land. Section 7 establishes that a person to whom a certificate of title for Commissioner’s land is to be issued shall pay a fee. The text consists of 34 sections and 2 Schedules.

The objective of this Regulation is to define the methods and principles of implementing Pasture Law No 4342. Pastures are classified by the principles of their vegetation quality as: “extremely good”; “good”; “medium” and “weak”. Grazing capacities are determined by the local branches of the Ministry of Agriculture and Rural Affairs. Pastures can be leased to farmers involved in animal husbandry for a period of 25 years. These farmers are obliged to implement rehabilitation plans, management plans, and grazing plans prepared by the Ministry.

An order by the Board under section l9(1) allotting or otherwise dealing with land vested in the Board under that section must be transmitted to the Native Lands Commission which must register the allotment or dealing in the Register of Native Lands. Until an allotment of or other dealing with vacant land is made under section 19(1), income arising from the control and administration of the land must be paid to the Central Fijian Treasury and used exclusively for the benefit of Fijians in a manner and for purposes approved by the Minister on the advice of the Great Council of Chiefs.

These Rules prescribe forms for purposes of the Registered Land Ordinance. They also lay down of the First Schedule the form of a register and in Schedule 2 the form of a Land Certificate. Other forms concern, among other things: transfer of land, transfer of lease, transfer of charge, a lease, a charge, grant of an easement and a notice of intention to appeal.

The Government, for the purpose of improvement of the mechanism of registration of payers of land charges and land rent for the land belonging to state (municipal) property, decrees to entitle district and city committees on land resources and land survey with the task of provision territorial, city and district state tax inspections with the lists of legal and natural persons – payers of land charges, compiled on the basis of the data of state land cadastre.

This Order of the President, made under section 16(1) of the State Land (Regularisation of Tenure) Act, 1998, empowers the Land Settlement Chairman with the execution of Deeds of Lease and with the granting of consent to assignments pursuant to section 15 of the Act on behalf of the President.

The land tenant shall be allowed to freely use of plants and trees that are planted by others, as far as such use is not excluded in the allocation order and subject to payment imposed by laws for the logging for other purposes than own use. If on the land timber is processed or balata or other forest products are exploited, except for own use, the tenant shall be subject to payment of such levies and charges as are applicable to such activities on land of the domain, except in case of exemption pursuant to a concession.

El presente Reglamento, que consta de 8 capítulos, 68 artículos, 2 disposiciones especiales, 3 transitorias y 1 final, dispone que el otorgamiento de tierras eriazas compete al Ministerio de Agricultura (art. 2º) y está condicionado a la existencia de aguas de libre disponibilidad, debiendo tramitarse el otorgamiento para el uso de dicho recurso en el mismo expediente que origina el pedido de tierras (art. 3º).

The present Decree codifies into one unified text the provisions of Royal Decree No. 19.12.1955/21.1.1956 and Legislative Decrees Nos. 3570/1956 and 3777/1957 regarding the income of local self-governments. Among other provisions, the Decree provides for the management of immovable property of local self-governments and establishes rules on licensing, leasing, rights of use and management of communal or municipal slaughterhouses (arts. 3-4), grasslands and pasture lands (arts. 5-11) and medicinal waters (art. 12).
