This Order establishes that granting on lease of the plots of land located within functional areas of national parks for recreational use shall be carried out in accordance with the Federal legislation on land and protected areas. Object of lease can be the following functional areas of national parks: (a) areas of tourism and education; (b) recreational areas; and (c) tourist service areas.
This Law regulates legal, economic and organizational grounds of relations originating from, acting and cessation of mortgage.
This Ministerial Decree establishes that the plots of land, natural objects, constructions and edifices on the territory of national parks for regulated tourism and recreation shall be conceded on lease to the holder of licence covering the aforesaid activities issued by administration of the national park. The period of lease shall be up to 50 years.
These Regulations prescribe forms for purposes of the Land Tenants (Security of Tenure) Act and provide that a landlord or a tenant may require a written memorandum of statutory lease in case of continuance of such lease. A memorandum of lease shall be in the form as prescribed in the Schedule to these Regulations and non-fulfilment of the requirements shall constitute an offence.
There shall be maintained in Port Vila a Land Records Office in which shall be kept a register to be known as the Land Leases Register. These Regulations provide for matters of the land Records Office such as Hours of public business of the Office, amendments, corrections, erasures, etc.
These Regulations, made under section 4 of the State Lands Act, specify in the Schedule fees that shall be paid in respect of the several matters to which they are applicable. The fees shall be payable to the Director of Surveys.
In case of existence of a right of pre-emption on an arable land or farm, the proprietor must notice the offer to buy, before the stipulation of the contract, to the persons entitled to pre-emption or privileged lease. The Decree contains detailed rules regarding the way of notification and acceptance or renouncement of the entitled person to pre-emption or privileged lease.
This Act provides rules for the registration of rights in land in the Seychelles. There shall be a Land Registry and an (appointed) Land Registrar. The Act also concerns the effect of registration, conversion of qualified title into absolute title, co-ownership and partition of land, registration of rights held by foreigners and the form of transfer of various rights in lands.
The Premier decrees to validate the form of the Model Contract on lease of land. The form is attached to the Ministerial Decree.
