The FAO Legal Office provides in-house counsel in accordance with the Basic Texts of the Organization, gives legal advisory services to FAO members, assists in the formulation of treaties on food and agriculture, for which the Director-General acts as Depositary, publishes legal studies and maintains a database (FAOLEX) of national legislation and international agreements concerning food and agriculture (including fisheries, forestry and water).

Fencing Act, 1963.

This Act requires owners to contribute to (jackal-proof) fencing of land by owners of land in areas of jurisdiction of divisional councils on designated on proposal of such councils. The Act also specifies duties and rights regarding fencing in areas where there is no requirement of contribution and, especiallly with regard to neighbouring properties (also if there insist usufructuary rights and servitudes on that such property). The Act also defines certain offences in respect of fenced land and fences.

This Act provides for the expropriation and taking for use of land and other property (movable or immovable), by the Minister of Public Works (in certain cases including an executive committee) or by certain local authorities, for public and certain other purposes. Notice of expropriation to owners as well as offers of compensation must be made. If owners do not claim specific amounts of compensation, the Minister will make an offer for compensation. The Act sets out the criteria for determining compensation are contained.

Directions in terms of section 20(5)(b) of the Environment Conservation Act with regard to the control and management of general and communal and general small waste disposal sites (G.N. No. 91 of 2002).

This Notice, made under sections 25 of the Environment Conservation Act, 1989, contains directions regarding the control and management of general and communal and general small waste disposal sites. The Directions concern, among other things: registration of sites; specification of waste that may be deposited at sites; planning, construction and decommissioning of sites; operation, access and monitoring of sites; reporting; closure and rehabilitation of site; and leasing and alienation of sites. The Directions also provide for punishment of offences.

Identification of activities which may have detrimental effect on environment: Pennington Sensitive Coastal Area and Umtamvuna Sensitive Coastal Area.

This Notice of the Minister of Environmental Affairs and Tourism, made under section 21 of the Environment Conservation Act, 1989, identifies in Schedule 1 activities that may have a detrimental effect on the environment in respect of areas included in Schedule 2, which form the Pennington Sensitive Coastal Area and Umtamvuna Sensitive Coastal Area. Those activities include: disturbance of vegetation, dredging, dune stabilisation and earthworks.
