Act to amend the Landholding Control: by deleting “corporation” and “corporations” wherever they appear and substituting “company” and “companies” respectively; by deleting “person belonging to Montserrat” wherever it appears and substituting “Montserratian”; by deleting “person not belonging to Montserrat” and “persons not belonging to Montserrat” wherever they appear and substituting “nonMontserratian” and “non-Montserratians” respectively; and by providing anew with respect to land and mortgages held by nonMontserratians.

Le présent décret régit les modes d'acquisition des terres rurales par des nationaux et non nationaux et leur transfert conformément aux dispositions des articles 8 et suivants, 355 et suivants de la loi 2013-01 du 14 août 2013 portant code foncier et domanial en République du Bénin.Le propriétaire bénéficie d'un droit d'usage, de jouissance et de disposition sur sa terre, droit qu'il exerce de la manière la plus absolue dans le respect des lois et règlements, notamment ceux portant sur l'obligation de mise en valeur, d'aménagement, de sécurité et de protection de l'environnement.

An Act Against Criminal Conveyance of Land (Cap. 95).

This Act amends the Penal Law so as to introduce measures against unauthorized possession or occupation of land and criminal conveyance of land. “Criminal conveyance” means the conveyance through sale, donation or lease of land by a person who has no title to do so. The Act defines offenses relating to criminal conveyance of land and prescribes penalties for such offences. The Act also defines affirmative defense.

This Act amends the Land Sales Act in provisions concerning land acquired by non-residents. The Act modifies the definition of "resident" and inserts a new section (7A) on acquisition of State or freehold land within town borders by non-residents for residential purposes. This shall not limit or prevent the sale, transfer or lease of any State land or freehold land to a non-resident for: (a) industrial or commercial purposes; (b) residential purposes within an integrated tourism development; or (c) the operation of a hotel.

Land tenure institutions in customary land areas of Sub-Saharan Africa have been evolving towards individualized ownership. Communal land tenure institutions aim to achieve and preserve the equitable distribution of land (and hence, income) among community members. Uncultivated forestland is owned by the community or village, and as long as forest land is available, forest clearance of forest is easily approved by the village chief.
