This Act provides for the expropriation and taking for use of land and other property (movable or immovable), by the Minister of Public Works (in certain cases including an executive committee) or by certain local authorities, for public and certain other purposes. Notice of expropriation to owners as well as offers of compensation must be made. If owners do not claim specific amounts of compensation, the Minister will make an offer for compensation. The Act sets out the criteria for determining compensation are contained.

Article 1 of the above-mentioned Law establishes that a special Fund shall be created to finance measures concerning the creation, preservation, acquisition, creation or protection of valuable landscapes and townscapes, of natural and cultural objects, as well as recreational areas. Article 2 establishes that the resources of the Fund are destined, in particular, for the: a) acquisition of land and the establishment of limited real rights; b) compensation of landowners; c) financing of other measures. The execution of cadastral work and inspection shall be performed by a surveyor covered by insurance policy for liabilities in omissions committed by the surveyor or by the surveyor's staff. The insurance entity must be registered in an EU country and must be in addition to other existing insurances on losses due to the performance of cadastral survey.

The Act provides with respect to the amount of compensation payable for damage to agricultural crops and fruit trees. Where the damage amounts to total destruction, the compensation shall be calculated at the rates set out in the Schedule. If the damage is partial, the compensation shall be calculated on that proportion of the amount for total destruction directly attributable to the damage as may be determined by assessors appointed by the parties within four days of the occurrence of the damage.

The law brings forth the Code of compulsory acquisition (expropriation) of immovable property. It consists of two articles (ratification of the Code and entry into force). The Code sets out: the rules and conditions under which the Government may expropriate a person's ownership or other rights in or to immovable property for public purposes (Chapter A, art. 1-6); the procedures governing the conduct of the act of expropriation(Chapter B, art. 7-10); the conditions for cancellation or revocation of compulsory acquisition (Chapter C, art.

The first article of the present law brings forth amendments throughout the text of the Code on expropriation of immovable property in order to comply with the provisions of the Greek Constitution. In particular, a new article (article 7a) is added to the Code, dealing with the procedures governing the conduct of the act of expropriation. The second and last article sets out the entry into force of such amendments.

The present Law implements the Federal Soil Protection Act of 17 March 1998 (BGBl. I p. 502). In particular, the Law lays down provisions relating to rehabilitation of polluted sites through: 1) prevention of harmful soil changes; 2) protection of soil against erosion and adverse effects on soil structure; 3) a sparing and careful use of land; 4) the remediation of harmful soil changes and contaminated sites and water pollution caused by this.
