La presente Ley modifica la Ley Hipotecaria aprobada por Decreto de 8 de febrero de 1946, y la Ley de Catastro Inmobiliario, cuyo texto refundido fue aprobado por Real Decreto Legislativo Nº 1/2004, en relación a la necesidad de resolver las duplicidades administrativas entre el Catastro Inmobiliario y el Registro de la Propiedad, que son instituciones de naturaleza y competencias diferenciadas que, no obstante, recaen sobre un mismo ámbito: la realidad inmobiliaria.

La presente Ley Hipotecaria norma el derecho hipotecario, cuya finalidad es la armonización de los asientos del Registro de la Propiedad. El Registro de la Propiedad tiene por objeto la inscripción o anotación de los actos y contratos relativos al dominio y demás derechos reales sobre bienes inmuebles. Las expresadas inscripciones o anotaciones se harán en el Registro en cuya circunscripción territorial radiquen los inmuebles.

This Law amends and supplements articles 17 and 18 of Law No. 9948 of 2008 dealing with the already-started land distribution procedures regulated by previous Laws No. 7501 of 1991 and No. 8312 of 1998 and provides local government structures with more time to finalize the documentation. It also adds article 19 according to which the decisions of the municipalities’ and communes’ councils and the documentation of land property completed by them according to law 9948 of 2008 during the period of 31 December 2013 to the date this law enters into force are considered valid. This Act amends the Penal Law so as to introduce measures against unauthorized possession or occupation of land and criminal conveyance of land. “Criminal conveyance” means the conveyance through sale, donation or lease of land by a person who has no title to do so. The Act defines offenses relating to criminal conveyance of land and prescribes penalties for such offences. The Act also defines affirmative defense.

Article 8 (5) shall be amended to add the following wording: “The right to once-only allotment free of charge in ownership of land plots for gardening, horticulture or peri-urban agriculture shall be granted to citizens having already in actual use the aforesaid plots of land. The scope of this Regional Law shall be performance of municipal land control by local government in the sphere of land relations. The object of land control shall be examination, review and check of the correctness of information and data contained in land documentation related to land ownership.

The purpose of the present Act is to afford protection to farmers against loss of their farm land. For the purpose of the present Act “farming” includes livestock production, poultry breeding, dairying, tillage of the soil, bee-keeping, fur farming or any other activity undertaken to produce primary agricultural produce and animals. The present Agreement among the Selkirk First Nation and Her Majesty the Queen in Right of Canada and the Government of the Yukon establishes the framework of a modern First Nation Government. In particular, the Agreement provides for the power to enact laws of a local or private nature on settlement land and for many aspects of the citizens' lives (marriage, adoption, education, administration of estates, etc.).
