Joint Decree No. 303/9 of the Council of Ministers and of the National Bank validating the Regulation on transfer of land plots in private ownership in mortgage for land based credit.

This Joint Decree establishes that separate land plots can be transferred in mortgage for land based credits. Legal persona and natural persons that are Belarus nationals can be mortgagers if their ownership right to land plot is certified by state land certificate. Banks authorized by the President of Belarus shall be mortgagees. Amount of credit and the modalities of extinction thereof shall be determined by credit contract and mortgaged contract.

Conveyancing Act.

This Act sets out rules relative to conveyancing of title in property, including land, and related matters such as rights related to leases and mortgages.The rules concern, among other things, contracts of sale, procedures for transactions, the role of court in case of encumbrances or other legal complications, conveyance of easements and other land-related rights, conveyance in case of statutory mortgage, rights of mortgagees in relation to timber on mortgaged property, covenants as to lease and mortgage and construction and effects of deeds and other instruments.

This Act concerns the validation of bona fide voluntary conveyance of lands, tenements or hereditaments. “Conveyance” includes every mode of disposition mentioned or referred to in specified enactments. This Act does not apply in any case in which the author of a voluntary conveyance of any lands, tenements, or hereditaments has subsequently, but before the passing of this Act disposed of or dealt with the same lands, tenements, or hereditaments to or in favour of a purchaser for value.

Settled Land Act.

This Act sets out rules for the sale, partition, lease, administration by trustees, mortgaging, exchange, etc. of settled land and certain rights related to the use of such land. The Act sets out criteria and definitions as to what land is considered settled land. It defines the right of a tenant for life in respect of such land including lease of land for mining purposes. The Act sets out certain rules applicable to mining leases.

Law No. 94-1 on housing facilities.

This Law regulates relations regarding housing facilities, including plots of land pertaining to common property of condominiums. In case of demolition of residential building because of expropriation for public needs of the plot of land on which it was located the owner shall have the right to another residential space or compensation at his choice (art. 15). Transfer of residential space shall entail transfer of land ownership (land tenure) rights to a new owner (art. 19).

Law No. 310-III ZRK on state registration of immovable property and related transactions.

This Law establishes the purpose, obligations and legal grounds regarding the registration of immovable property and related transactions. The following rights to immovable property shall be subject to state registration: (a) ownership; (b) economic management; (c) operating management; (d) land tenure of at least one year; and (e) servitude for a period of no less than one year. The following pre-emptive rights shall not require mandatory state registration: (a) land tenure for a period less than one year; and (b) servitude for a period less than one year.
