El presente Decreto reglamenta la Ley Nº 1.152 de 2007 en lo relativo a la clarificación de la situación de las tierras desde el punto de vista de su propiedad y el deslinde de las tierras del dominio de la Nación, con el objeto de identificar las que pertenecen a la Nación, calificar y definir la eficacia jurídica de los títulos y demás documentos que en relación con el derecho de propiedad que presenten los particulares.

This Act provides rules for legal proceedings regarding the partition of land and other properties held in possession by more than one person. The Supreme Court may order sale instead of partition of property if this would result more practical or beneficial to the parties involved. The Court may purchase parts of parties interested in sale and may allow other parties to bid at the sale at conditions set by the Court.

Sub-divisions (Local Improvement Associations) Act (Cap. 258).

This Act makes provision for the formation and administration of “Local Improvement Associations" and defines rights and duties of such associations. An association may be formed by owners of lots of a sub-divided estate for the purpose of the carrying out of works in common and various other matters relating to the sub-divided land including matters regarding the maintenance of inland waterways. The procedures for establishment foresee, among other things, a petition by owners to the Minister and incorporation of the association.

This Chapter lays down rules relative to the division of public lands. It specifies powers and duties of the Chief of Lands and Surveys regarding the subdivision of public land and in particular lands that are adjacent to the sea or tidal areas. Reasonable public access shall be secured in public areas to be subdivided or offered for sale.

This Chapter establish rules for securing public access to areas that are public lands and that are subject to subdivision into smaller parcels, tracts or lots for sale, lease, homestead, exchange or allocated for any other purposes or any public land abutting the sea or tidal areas that is proposed to be sold, leased, homesteaded , exchanged or allocated. The Board of Trustees shall have the power to promulgate Rules and Regulations, subject to the approval of the Governor, to implement the provisions of this Chapter. Such Rules and Regulations will have the force and effect of law.

The First Nations Land Management Act (FNLMA) was passed by the federal Parliament in 1999 on the initiative of fourteen Indian Act Bands wishing to escape the land management provisions of the Indian Act in order to improve their capacities and opportunities for economic development. The Act provides the term "first nation" meaning an Indian Act band named in a schedule. Additional First Nations may request the Governor-in-Council to have the Act applied to them.

The present Act establishes that a band, or its council, may make agreements with Canada and British Columbia for resolving and extinguishing claims to cut-off lands. It notes that "Negotiations toward such agreements do not constitute an admission by Canada of the existence of any legal obligation of Canada toward the band in question" and that "Any such agreement executed prior to this Act is declared to have effect as of the date of its execution." The text consists of 7 sections.
