The Community Land Act of 2016 provides a legal basis for protection, recognition and registration of community lands andhas provisions for management and administration of the land by the communities themselves. However, implementation of the act has been slower than anticipated. This is despite the current  heightened investment interests in community lands for mega development projects.

In October 2016, women farmers from 22 countries across Africa climbed the peak of Mount Kilimanjaro to claim women’s rights for access to and control over land and natural resources. This event coincided with the launch of a campaign of the African Land Policy Centre (ALPC) to reach the target of having 30 percent of all registered land in the name of women by 2025 and to embed women’s land rights into the targets of the Sustainable Development Goals (SDGs).

In essence, the Netherlands and England & Wales answer this question in the affirmative. The only thing that stands in the way of anyone accessing this information in the land registry is the payment of a small fee. In Germany, on the other hand, access to this personal data is restricted to the person who can show a legitimate interest in the information.

Across Africa, Asia and Latin America, investors are increasingly approaching rural communities seeking land for logging, mining, and agribusiness ventures. Even in those situations where the investors have followed FPIC guidelines and undertaken a formal “consultation” with the community, these consultations are generally conducted in a context of significant power and information asymmetries. Part of the power imbalance comes from communities’ lack of information about the value of community lands and natural resources.

Target 5.a aims to "undertake reforms to give women equal rights to economic resources, as well as access to ownership and control over land and other forms of property, financial services, inheritance and natural resources, in accordance with national laws".
