This Law regulates the official survey of real estate, real estate cadastre and communal facilities, and records necessary for the correct data collection and additional cadastre registration requirements.This Law further defines all administrative and technical rules governing the agricultural land cadastre on the territory of the Republic of Srpska (Federation of Bosnia and Herzegovina).The Law is divided into XIII Chapters and 121 articles, including all offences and related penalties.

This Law prescribes all necessary measures and rules for the mandatory keeping, maintenance and establishment of the official land registry (Land Book), as well as the registration of real estate and natural property units in the land register of the Republic of Srpska.This Law further defines the land commission and its responsibilities, parcelling and specific administrative requirements, and various other legal and administrative forms.The Law is divided into 14 Chapters and 95 articles, including all transitional provisions.

Articles 6, 9, 14, 30 have either been amended or new paragraphs have been added. The present Law also amends new articles of the Village Law of 1924, the Law on Natural Disasters 1959, and the Tourism Incentives Act of 1982. The formation of the technical teams is re-defined. The in-forest pastures and grazelands are re-defined by a committee set up by the Ministry of Environment and Forestry and cannot be used for any other purposes unless their allocation purposes are modified.

This Law regulates land registration and restriction of the right of ownership. In the Register of immovable property shall be recorded plots of land that have been attributed cadastre number (Art. 9). The following rights shall be recorded in the Register: (a) ownership; (b) servitude; (c) usufruct; (d) mortgage; and (e) long-term rent (Art. 11).

This Law establishes the modalities of: (a) setting up, keeping and liquidation of the state registers (cadastre); (b) setting up the system of the state registers and the basic principles of interaction thereof; and (c) the rights and the duties of the leading institutions as regards keeping the state registers. The object of recording in the state registers shall be inter alia territory (land) and natural resources. One on the main registers shall be the register of immovable property.

The aim of this Decree is to regulate land registration. This Decree is composed of 4 articles. Article 1 decrees the change of the name of the Bureau from Cadastre Bureau to Survey and Cadastre Bureau. Article 2 divides the Bureau in the following Departments: (a) Survey; (b) Registration and Monitoring; (c) Administration Affairs and Finance; and, (d) Technical Affairs. Article 3 entrusts the Prime Minister to issue the necessary resolutions for defining the functions and duties of each Department.

Article 21 shall acquire a new wording: “Article 21. Inadmissibility of the use of land plots before delimitation of the boundaries thereof in situ. Landowners shall not be authorized to use land plots allotted by the local self-government out of the stock of public land before delimitation of the boundaries thereof in situ by the State Agency on Land Relations and Cadastre”.

The Land Cadastre Act provides the bases for maintenance of the land cadastre (hereinafter cadastre), the objective of maintenance of the cadastre, the procedure for registration of cadastral units, the composition of cadastral data and the procedure for the processing thereof, and the procedure for the financing of the cadastre.
