The amendment of section 5 concerns the publication date of proposed controlled transactions (at least ninety days before the transaction takes place) and the information to be included in a notice of transaction. Section 8 is amended so add a requirement of documentation regarding the price of transaction for registration purposes.

This Act amends the principal Act with respect to modification of the Adjudication Record (sect. 7), to special powers of the Demarcation Officer (sect. 12) and to appeal against decisions of the Adjudication Officer (sects. 15, 17 and 20). Section 23 concerning the finality of Adjudication Records and subsection 24 concerning appeal in court are repealed and replaced by a new provisions.

The 28 sections of the Act are divided into 6 Parts: Preliminary and Application (I); Officers (II); Claims and Demarcation (III); Principles of Adjudication and Preparation of Adjudication Record (IV); Objections and Finality (V); Miscellaneous (VI). For the purposes of appeal against adjudication records prepared by the Recording Officer in accordance with principles laid down in sections 16 to 19, a Land Adjudication Tribunal shall be established by the Minister (sect. 4(5)). Claims will be handled in first instance by the Adjudication Officer (sect. 20).

This Decree Law is composed of 8 articles. Article 1 defines requirements and conditions for the possession and acquisition of lands and buildings by physical and juristic citizens from Countries of the Gulf Cooperation Council (GCC). Article 3 deals with the transfer of the ownership of lands acquired in accordance with this Decree Law. Articles 5 and 6 pertain to the expropriation and registration of lands acquired by citizens of the GCC.

The senior matai in charge of communal lands belonging to his family, or the male members of the family owning and residing on communal lands, or the owner of individually owned lands or freehold lands, shall have the power and authority, as limited by this Chapter, to agree with any person that any structure now existing or hereinafter erected on such lands shall not be or become a part of the real estate, but shall remain separate and distinct therefrom, subject to ownership separate from the land, and also subject to the right of removal by the owner of the structure.

This Act provides for a wide variety of matters relating to land, land use rights, transfer of land, etc. All land subject to the provisions of the Land (Transfer and Registration) Ordinance and every estate or interest therein and all instruments and dealings affecting any such land, estate or interest shall from the commencement of this Act be deemed to be subject to the provisions of this Act.

This Law provides for the institution of the national Cadastre and Survey Organization, its functions and powers, involving activities dedicated to the management of cartography and topography of land. It is a public organization under the responsibility of the Ministry for the Environment, Physical Planning and Public Works. It is presided by a seven members Committee. The Committee’s mandate has duration of three years and may be re-elected without any restriction.
