Documento de trabajo sobre tenencia de la tierra 11. Esta publicación compartida por la FAO y Naciones Unidas-Hábitat trata de comprender y definir mejor los procesos, los mecanismos y las instituciones de la gobernanza de la tenencia en áreas rurales y urbanas. En el documento se reconoce que se han realizado excelentes políticas de la tierra, leyes y reformas técnicas. Sin embargo, su implementación en muchos casos ha sido errónea, ha sufrido retrasos o, incluso, se ha invertido.

Land Tenure Working Paper 11. This co-publication of FAO and UN-HABITAT seeks to better understand and define the processes, mechanisms and institutions of governance of tenure in rural and urban areas. The paper recognises that excellent land policies, laws and technical reforms have been developed. However, in many cases their implementation has slipped, stalled or even been reversed. By adopting a governance and political economy perspective, the paper offers insights for the design of reforms and for the development of land governance tools.

The articles in this volume supplement FAO Land Tenure Studies 10, Compulsory acquisition of land and compensation. The latter publication explains what compulsory acquisition and compensation are and what constitutes good practice in this area. This current volumes introductory article provides an overview of these issues. The issue of compulsory acquisition from a human rights perspective is also addressed here as are the concepts of market value, compensation value and just terms compensation.

Os sistemas de apoio à família alargada que costumavam funcionar como redes de segurança social para as viúvas e crianças órfãs enfraqueceram como consequência de mudanças na sociedade, tais como desenvolvimento económico, a migração e a urbanização. Esta situação foi claramente exacerbada pela epidemia do SIDA.

Women and childrens' insecure rights to property and inheritance in many countries in sub-Saharan Africa is not a new issue. The extended family support systems that used to function as social safety nets for widows and orphaned children have weakened as a consequence of societal changes such as economic development, migration and urbanization. This situation has clearly been exacerbated by the AIDS epidemic. Though prevalence is starting to level off, or even decline, in several high prevalence countries, this comes after years of increasing prevalence.

Based on international authoritative documents, this paper draws 14 principles to be taken into account when developing Voluntary Guidelines on Responsible Governance of Tenure of Land and other Natural Resources. Land Tenure Working Paper 8. This paper articulates the views and demands of marginalised groups regarding the tenure of land and other natural resources. It points out the importance of adopting human rights framework when developing Voluntary Guidelines. Such framework means addressing the unequal relationships of power and corruption within and behind prevailing land tenure structures. It makes the governance of tenure of land and other natural resources more accountable, transparent, democratic and participatory.
