This Regional Law establishes plenary powers of regional state bodies and local government related to land tenure of urban land pertaining to public land. It shall not be applicable to agricultural land and land of protected areas.

This Regional Law regulates the issues of conservation, protection, management and reproduction of recreational forests in urban areas with a view of creation of favourable environment for the population. It shall also regulate the issue of afforestation and reforestation in urban areas. Regional executive bodies shall be responsible for education of the population related to management, keeping and reproduction of green plantations in urban areas.

La presente Ley amplía la vigencia del Régimen Extraordinario al Organismo de Formalización de la Propiedad Informal (COFOPRI), exonera el pago de tasas u otros cobros y otorga facultades excepcionales en materia de formalización en las zonas afectadas por los sismos del 15 de agosto de 2007.

This Regional Law establishes the grounds for and the modalities of transfer free of charge on condition of ownership to local government of land plots pertaining to regional property. The aforesaid transfer shall be performed for municipal land-use planning and development of urban areas. Land pertaining to regional property free of third-party claims and not occupied by constructions and edifices can be transferred to local government. The aforesaid transfer shall be performed by decision in the forms of Governor’s Decree.

This Regional Law regulates relations in the sphere of protection, management and reproduction of urban forests with a view of creation of favourable environment for the population. The role of urban forests shall be as follows: (a) recreational, ecological, aesthetic, sanitary and other protection functions; (b) tourism and sport. In case of planning of economic activities on areas under urban forests reforestation and forest conservation arrangements shall be envisaged.

The Law 10345 of 2010 amends Article 61 of Law 8093 of 1996 by increasing the financial penalties for violation of the Law and adds Article 71/1 on the rules of procedure to be followed by the National Urban Planning and Construction Inspectorate to document the law violations.

The Law 10319 of 2010 amends Law 8405 of 1998 on several topics including the permits needed for placing advertisements on the streets, the rights and duties of the urban planning inspectorate, the procedures of demolishing unlawful constructions, etc. A new form for “Connection of the object with the road infrastructure” has been approved and attached to the Law.

This Decree-Law, consisting of 7 Chapters, approves the National Regulation for Land and Urban Planning (RNOTPU). it specifies the basic legislation for territorial planning and its management, as established by Legislative Decree No. 1/2006. The purpose of this Act is to establish the fundamental objectives and rules of regional development and land use planning, and to define the institutional system therefor. This Act shall apply to the implementation of regional development and land use planning duties on national and regional level, and the provisions of this Act shall apply to natural persons and legal entities, as well as unincorporated organizations participating in or affected by the above activities.
