Regional Law No 316-Z “On regulation of land relations”.

This Regional Law regulates the issues of allotment once-only free of charge of agricultural land plots out of stock of public and municipal land in ownership to some categories of citizens, including multiple children (three and more) families, for peasant farming, subsidiary smallholding, horticulture, gardening and suburban individual housing construction. Order on allotment of land shall be issued and legalized by local government.

Regional Law No. 1775-OZ amending Regional Law No. 1005-OZ “On allotment of land plots free of charge to citizens”.

Article 2 shall be amended to add the following wording: “Plots of agricultural land shall be allotted to specific categories of citizens for agricultural production, other purposes related to agricultural production, for suburban farming and for individual housing construction”.

Law on improvement of soil and agricultural buildings (Soil Improvement Law).

Article 1 of the present Act establishes, that, in particular, forestry and agriculture shall benefit from soil improvement measures. Soil improvement shall be carried out with a view to land use planning, as well as to protect nature, landscape, cultural heritage, waters and the environment in general. Le remembrement des terrains à bâtir est régi par la loi sur l’aménagement du territoire et les constructions.

Article 45 shall be amended to add the following wording: “The right to permanent (open-ended) tenancy of a land plot can be mandatorily stopped in the following cases: (a) non-purposeful use of land with flagrant violation of rational land management regulations; (b) soil damages; (c) non-fulfilment of land reclamation arrangements; and (d) non-utilization of agricultural land for agricultural purposes for a period of three years and over”.

This Act lays down rules regarding the acquisition of property rights of agricultural and forestry lands, the institution of usufruct right on such lands, the use of land, the control on restrictions relative to the acquisition of land, and rules regarding local land commissions. This Act applies to all land in the national territory.

This Act provides that the owners of (undivided) shares in any land representing more than 51 percent in any area may present a petition to the Minister for the partitioning or re-allotment of land. The Minister may appoint an officer to partition and re-allot (sect. 6). The powers of such officer are specified in section 7 to 12. Where an owner of any share or holding in land cannot be ascertained, the officer may order the share or holding to be sold by public auction (sect. 11). The Officer may determine compensation for the loss of crop (sect. 13).

The Act makes provision for the collection of taxes on acres of land imposed by Parliament. Rates of levy may vary according to the use of (arable) land. The proprietor of any plantation or any land of which any acreage tax is payable, shall provide the Commissioner of Land each year with a return in Form 1 contained in the Schedule. Rice Farmers (Security of Tenure) Act (Cap. 69:02).

This Act provides for a further regulation of land tenure contracts between rice farmers and landlords in order to strengthen the position of the former. The Minister may establish committees which shall perform several duties in relation with the assessment of rents and the observance of conditions of contracts of tenancy in a specified area (sects. 8 to 26). The Minister may make regulations to implement provisions of this Act (sect. 55). (59 sections and 5 Schedules)
