El presente Decreto interpreta el artículo 135 de la Ley de Reforma Agraria, en el sentido de que la facultad que corresponde al Estado de conocer y resolver todo lo relacionado con la tenencia y explotación de las tierras destinadas a la reforma agraria, incluye el arrendamiento de tierras rurales susceptibles de uso agrícola o ganadero.

Alienated Land (Information) Act [Chapter 20:02].

This Act concerns control on the use of alienated land. Whenever the President considers it necessary or expedient to do so, he or she may make Regulations for the purpose of ascertaining the nature and extent of the occupation or use of alienated land (sect. 2). The Regulations may, among other things, require owners or occupiers of alienated land to supply specified information and prescribe powers and duties of officers appointed under section 4. Such officers may be appointed by the Minister for the purpose the nature and extend of occupation and use of alienated land.

This Act places restrictions on trespass by persons on property. Entry on premises, including vessels and other structures, may be prohibited by notice and entry is prohibited without any notice on premises: (a) consisting of a garden, lawn, field, plantation under cultivation or orchard; or (b) that is enclosed in a manner that indicates the occupier’s intention to keep persons off the premises or to keep animals on the premises. Offences are defined and penalties prescribed

The Order deals with the limitation of land property by terms of its size that must not exceed 100 bights if the land is owned by family or individuals. The amount of exceeding land must return to the Government. An exemption is liable to be apllied in case of land owned by religious organization, farmers’ cooperatives or if tea, rubber, cocoa or coffee are being cultivated there; or when its use is being taken in account for industrial projects, when considered beneficial to the public interest.

Inner Bank Titles Act [Chapter 20:09].

This Act concerns the ownership of so-called “inner banks”. Section 2 makes provision for the definition of boundaries in original grants of land made by the British South Africa Company. The boundary shall be the centre of the said river or stream. Any subsequent transfer of land the boundary of which is so described under one undivided transfer shall be deemed to have conveyed the land up to the centre of the river or stream mentioned as a boundary in the original grant or diagram, and to have vested the ownership of the land as thus bounded in the holder of the title to the land.

Transfer of Immoveable Property Restriction Act, 1987.

This Law, consisting of five Chapters, regulates the requirements to transfer the land ownership of any immoveable property. It specifies terms and conditions to deal with land, benefits from the land, building and things constructed or situated on that land and things installed on those buildings. It establishes land property restrictions, registration, offences and penalties.

Cette ordonnance établit le régime foncier et domanial en Mauritanie.La terre appartient à la nation et tout Mauritanien, sans discrimination d'aucune sorte, peut, en se conformant à la Loi, en devenir propriétaire, pour partie. L'Etat reconnait et garantit la propriété foncière privée qui doit, conformément à la Chariâa; contribuer au développement économique et social du pays. Le système de la tenure traditionnelle du sol est aboli. Les terres qui ont appartenu à l'Etat, en vertu des dispositions de la loi n 60.139 du 2 Août 1960, demeurent domaniales.

This Law focuses on the reorganization of landownership subject to agricultural land projects. It provides for ways to compensate landowners for expropriation and gives indications concerning the recording of land. It is the duty of the Lands and Appropriation Committee to notify the corresponding Real Estate Registration Department.

This Act stipulates that no dealings in agricultural land, i.e. sale, transfer, lease of more than five years, exchange partition, division, etc. shall be contracted with a person not being a citizen of Botswana unless the Minister has given his/her consent to that transaction (sect. 3). This rule does not apply to companies registered under the Companies Act. Proposed transactions of this kind shall be advertised in accordance with section 5. Section 7 sets out criteria for decision making of the Minister with respect to the granting of consent.
