Regional Law No. 318-OZ “On protected areas”.

This Regional Law classifies protected areas as follows: (a) natural parks; (b) state nature reserves; (c) nature monuments; (d) dendrological parks and botanical gardens; (e) healthcare areas and spas; and (f) traditional nature management areas of indigenous peoples. Protected areas of regional significance shall be property of the regional administration. Inclusion of land parcels pertaining to natural and legal persons on condition of ownership, tenancy or lease into protected areas category shall be allowed. Boundaries of protected areas shall be mapped.

Regional Law No. 539-ZCHO “On turnover of agricultural land”.

This Regional Law regulates relations related to tenure, ownership and management of agricultural land. It establishes minimum agricultural land area in the process of land consolidation of 0,04 ha. Maximum agricultural land area owned by a single natural or legal person shall not exceed 10 percent of total available agricultural land area. Regional administration shall have preferential terms for purchase of agricultural land at established price. Minimum period of lease of agricultural land for agricultural production shall be 11 months, for other authorized uses – 10 months.

Real Estate (Dealers and Developers) Act.

This Act establishes the Real Estate Board and provides rules for the registration and operation of real estate dealers, real estate salesmen and real estate developers. It also provides for certain matters regarding development schemes and for inspection by real estate inspectors. Engaging in real estate business for purposes of this Act includes lease of land and the management of land. The functions of the Board shall be to regulate and control the practice of real estate business, the disposition of land in development schemes and the operation of such schemes.

Regional Law No. 4-oz “On land charges”.

This Regional Law shall be aimed at the development of land relations and improvement of the mechanism of state regulation of payment of land charges. It establishes that the amount of payment for agricultural land allotted to agricultural enterprises, peasant farms, cooperatives and subsistence farms for agricultural production shall not exceed the amount of taxes applicable to land parcels allotted on lease.

Regional Law No. 1101-KZ “On attribution to local government plenary powers related to management of public land pertaining to re-distribution land stock”.

This Regional Law regulates relations concerning attribution to local government plenary powers related to management of public land pertaining to re-distribution land stock. In particular it envisages the modalities of auction sale of the right of lease of public land and conclusion of lease contracts. It regards transactions with agricultural land.

Las enmiendas tienen por objeto la inembargabilidad e insusceptibilidad de venta judicial de las tierras fiscales afectadas por el Poder Ejecutivo a planes de colonización, obras públicas, desarrollo rural, actividad económica estatal, urbanización o construcción de viviendas y otros fines de perfeccionamiento social, las mejoras enclavadas en éstas y los derechos y acciones que existan o pudieran existir sobre las mismas.

Registration of Titles Act.

This Act provides the registration of titles and the appointment of the Registrar of Titles and contains various rules relative to title in land and other rights and interests in respect of land, transfer of titles, etc.The Governor-General shall appoint a Registrar of Titles, Deputy Registrars of Titles and a Panel of Referees of Titles. The Act provides for the lodging of caveats with the Registrar of Titles by persons claiming an interest in land forbidding the bringing of land under the working of this Act.

Presidential Decree No. UP-3780 on privatization of land plots occupied by buildings and constructions of legal persons and citizens.

With a view to ensure purposeful and efficient land use, and also for the development of housing and mortgage market, the President decrees to authorize privatization by legal persons of land plots on which buildings and constructions are located from 1 January 2007. Long-term lease contracts applicable to the plots of land that have not been privatized in accordance with the above-mentioned modalities shall be subject to re-registration. Natural persons shall be authorized to privatize land plots allocated thereto for individual housing construction from 1 January 2008.

Amending Act on the interpretation of federal legislation in respect of the Federal Ministry for Food, Agriculture and Consumer Protection.

I p. 1260); article 17 of the Animal Protection Slaughtering Ordinance of 3 March 1997 (BGBl. I p.406).

The stock of land in accordance with its destination is subdivided into the following categories: 1) agricultural land; 2) urban land; 3) industrial land; 4) land of protected areas; 5) forest land; 6) water land; 7) reserve land. The document consists of 5 Sections composed of 21 Chapters that contain 170 articles. Section 1 (Chapters 1-2) lays down general provisions. Chapter 1 (arts. 1-12) lays down general provisions. Chapter 2 (arts. 13-19) establishes competence of state institutions in the field of land relations.
