Ministerial Decree No.333 of 1994 regarding validation of the Regulation on the modalities of transfer of land from one category into another and low-yield land into unproductive land.

The present Regulation establishes the modalities of forwarding application and legalization of materials for the purpose of transfer of land from one category into another and low-yield land into unproductive land. Reduction of the area of irrigated land, arable land, perennial plants and other high-yielding areas, including transfer of land from one category into another and low-yield land into unproductive land shall not be allowed except for cases of necessity and exclusively in accordance with the Ministerial Decrees. Transfer of irrigated land into the category of non-irrigated land shall be carried out in the following cases: 1. reduction of debit of water in the sources of irrigation; 2. loss of communication with the source of irrigation; 3. new construction of irrigation systems on the formerly irrigated land; 4. wreck of the irrigation system if it cannot be restored. Transfer of perennial plants shall be authorized in the following cases: 1. thinning out and impossibility of reforestation; 2. damage caused by pests, disease, disasters; 3. loss of production importance as a result of expiration of the period of exploitation and depreciation; 4. expropriation of land for state and public needs. Section II establishes the modalities of forwarding application and legalization of materials for the purpose of transfer of land from one category into another.
