The present Act lays down provisions relating to the cultural heritage in the province of New Brunswick. The Act strengthen the province’s ability to conserve heritage sites and objects by establishing the Crown as legal owner of heritage objects, and prohibiting the alteration of heritage sites. Furthermore, the Act improves the existing process of designating heritage places, including providing opportunities for public input, establishing a means for the public to nominate places having provincial significance, and establishing linkages to the provincial land registry for sites that are designated. Fines for non-compliance with heritage conservation laws are increased, making them comparable with those in other jurisdictions in Canada; expanding the scope of municipal-heritage authority to create bylaws, and giving municipalities more flexibility to tailor bylaws to community interests.
