The Government of the Republic of Estonia is the cabinet of Estonia. Under the Constitution, it is officially defined as Estonia's executive authority, and exercises executive power pursuant to the Constitution and laws of Estonia.

The cabinet carries out the country’s domestic and foreign policy, shaped by parliament (Riigikogu); it directs and co-ordinates the work of government institutions and bears full responsibility for everything occurring within the authority of executive power. The government, headed by the Prime Minister, thus represents the political leadership of the country and makes decisions in the name of the whole executive power.

This Act provides a basis for the procedure of all expropriation of immovable property including "restricted real rights". Expropriation" is defined in section 2 as "the transfer of an immovable without the consent of the owner in the public interest for fair and immediate compensation".

Return of and Compensation for Land Expropriated for USSR Military Bases Act (1993)

The Act regulates return of and compensation for land expropriated for USSR Military Bases in Estonia. It stipulates that the land expropriated by the Republic of Estonia during the period between September 1939 and 23 July 1940 for USSR military bases shall be returned or compensated for to the persons whose land was expropriated or to the successors thereof, regardless of the manner in which the land was expropriated. Such land must be returned with all the buildings and structures situated on the land at the time of expropriation, if they have preserved.

The Act determines the bases and procedure for valuation of unlawfully expropriated property being the object of ownership reform and the method and extent of compensation thereof. The bases and procedure for valuation of unlawfully expropriated land and the natural objects attached thereto and collectivised property, and the method and extent of compensation thereof must be determined by separate Acts.

The Act regulates simplified procedure for proving unlawfulness of expropriation of property in Estonia. If a natural person having been the owner of property was forced to abandon his or her property during the period between 16 June 1940 and 1 January 1954 due to escaping from his or her place of residence or the location of property or in connection with refusing to return to Estonia while staying abroad, the property must be deemed to be abandoned due to a real danger of repression.
