Prince Edward Island Land Protection Act (R.S.P.E.I. 1988, c. L-5).

The purpose of this Act is to provide for the regulation of property rights in Prince Edward Island, especially the amount of land that may be held by a person or corporation. Section 2 establishes the maximum land holdings, section 4 concerns land holdings by persons who are not resident in the Province. Section 6 is dedicated to land holding permits, their effects and requirements. Other provisions concern access to information (sect. 10), enforcement (sect. 12), offences (sect. 13) and investigation (sect. 15).

Land Survey Act (R.S.P.E.I., c. L-2.1).

This Act concerns land survey i.e. the establishment, location or definition on the ground of any boundary, limit or angle of any land, size, location, parcel, claim, common, easement, road, street, lane, district, municipality, country of township, or any other location or division of lands or right over lands whether for ownership, title or authority of the origin of any of them. Under section 2, a Chief Surveyor shall be appointed and sections 3 to 8 are dedicated to the coordinate system to be established in Prince Edward Island.

Landlord and Tenant Act (R.S.P.E.I. 1988, c. L-4).

This Act provides the legal framework for the relationship between landlords and tenants, it consists of 89 sections and is divided into four parts. Part I contains general provisions on leases, rents and covenants. Part II is dedicated to the distress for rent and related procedures. Part III concerns “ejectment proceedings liability of tenants overholding” and Part IV contains miscellaneous provisions.

Natural Areas Protection Act (R.S.P.E.I.c. N-2).

This Act has the object of preserving natural areas in the province of Prince Edward Island. Section 3 defines the criteria that the Minister of Fisheries, Aquaculture and Environment has to follow in order to designate any area of land as natural area. Under section 6, the Minister may appoint an Advisory Committee to advise him on the designation and management of natural areas. Under section 7, the Lieutenant Governor in Council is empowered to pass all regulation necessary for the implementation of the Act, the section spells out what can be subject matter for regulation.

Expropriation Act (R.S.P.E.I. 1988, c. E-13).

This Act concerns the expropriation of land for any purpose relative to the use, construction, maintenance or repair of public works. The Act also regulates access to land for the purpose of constructing or maintaining public works (sect. 3). The Act defines the procedure for expropriation and related registration requirements (sect. 7). Under section 11, compensation is foreseen for any damages resulting from the exercise of the powers conferred by the Act.
