This Act is formulated to prevent and remediate soil and groundwater pollution, ensure the sustainable use of soil and groundwater, enhance the living environment, and protect public health. It consists of 8 Chapters divided into 57 articles.Competent authorities at all levels shall, regularly monitor the quality of the soil and groundwater, and perform verification of sites suspected of having soil and groundwater pollution, and control pollution sources and investigate the state of environmental pollution.

The Regulation of the Minister of Environment is composed of 23 Paragraphs. Requirements concerning location, construction, exploitation and closure of waste landfills, must ensure the protection of human health and the environment, and in particular prevent the pollution of surface and underground waters, soil, land and air.

This Act creates a new legislative and management framework for the marine environment in Scotland. It, among other things: establishes a new system of marine planning to take into account marine environment protection and management matters, creates a system of licensing of marine activities and defines powers to establish marine protected areas to protect natural and cultural marine features. The Act also introduces a new regime for the conservation of seals and gives powers to Scottish marine enforcement officers to ensure compliance with the new licensing and conservation regime.

An integrated pollutant release and transfer register at the national level has been established to facilitate public participation in environmental decision-making. This Regulation of the Minister of Environment, which is composed of five paragraphs and one Annex, lays down: (1) form of report containing information necessary for the National Pollutant Release and Transfer Register, (2) forms of submitting the report; (3) required techniques of submitting the report. The form of the questionnaire is specified in the Annex.
