Africa has half of the world’s 25 million internally displaced persons (IDPs). These IDPs are citizens displaced by development projects, natural disasters or violence. Violence, linked to civil war or repression, is the predominant cause of displacement. As respected Kenyan lawyer Makau wa Mutua emphasizes, bad government is at the root of this tragedy “with the most repressive governments producing the largest numbers of IDPs”.[1] 

Recent years have witnessed a resurgence of interest in indigenous, traditional and customary approaches to peace-making in the context of civil wars. Supporters claim that indigenous approaches to peacemaking are participatory and relationship-focused, and that peaceful outcomes have a higher chance of community adherence than template-style international peace interventions effected through the `liberal peace'. Using historical and contemporary examples, this article assesses the feasibility of a complementary relationship between customary and Western forms of peace-making.

Report is in 3 parts: literature review findings, field study findings, recommendations. Divided into land justice and family justice and concludes by defining strategic interventions for the Justice, Law and Order Sector. Finds a dominant preference for disputes to be resolved at the lowest level possible, that lack of legal aid remains a big hindrance to access to justice, and that the conflict-affected districts of Lango, Acholi, Karamoja and Teso deserve special attention as a matter of urgency to resolve emerging land disputes and conflicts.

In the north-western department of Chocó, near Colombia’s border with Panama, forcibly displaced people have established “Humanitarian Zones” in a bid to hang on to their land and livelihoods. (...)

A fact-finding mission team was formed as a result of consultative meetings on the land dispute between the village government and pastoralists in Vilima Vitatu village in Babati district. Para Que Se Sepa – in English Let It Be Known – is a compilation of life stories told by people displaced by Colombia’s years of internal armed conflict and massive human rights violations.

For historical reasons, Kenya inherited a highly skewed system of land ownership at independence in 1963. British colonialism in Kenya was not merely administrative. Rather, it was accompanied by massive and widespread land alienation for the benefit of settler agriculture. As a result the best agricultural land-the White Highlands and the adjacent rangelands were taken from the Africans, without compensation, and parceled out to white settlers. Colonial legislation was enacted to legalize this process.

Internal displacement in Kenya is a complex and multi-faceted social problem that revolves around and reflects unresolved issues of land and property, as well as the struggle for the control of political and economic resources. (...)

In Rwanda, two factors make land a highly important and contested issue. First,
Rwanda has the highest person-to-land ratio in Africa. This creates tremendous
pressure on land in a country where most of the population lives in rural areas, and
where agriculture remains the central economic activity. Second, Rwanda is recovering
from massive population shifts caused by decades of ethnic strife and the 1994 civil war
and genocide, which resulted in displaced populations and overlapping land claims.
