The Act makes provision for the adjudication and registration of rights and interests in land in areas declared to be adjudication area by the Minister. Land shall be adjudicated by an Adjudication Officer appointed by the Minister. The Minister shall also appoint Demarcation Officers, Recording Officers and Survey Officers. The Act sets out the principles and procedure of adjudication.

The Act requires landowners to register Africans residing on their estate for the purpose of growing any economic crop for sale or performing any agricultural work. “African” means any person who is a member of an African community indigenous to Malawi, Tanzania, Zambia or Mozambique.

This Act defines powers and duties of Curator of Vacant Estates in respect of vacant estates and provides for the administration of such estates by the Curator.The Officer of the Curator of Vacant Estates is created under this Act and the Curator shall be appointed by the President. “Vacant Estates” shall comprise vacant successions and unclaimed property.

This Act regulates the carrying out of surveys of land by, appointment of, qualifications of, etc. land surveyors including Government surveyors, i.e. land surveyors who are public officers of the Ministry of Housing, Lands and Town and Country Planning.

This Act regulates the alienation, lease and use of and control over “State land”, i.e. defence lands, ‘pas géométriques’ and all lands belonging to or in possession of the State. The Minister may sell State land other than defence lands, mountain reserves which belong to the State, ‘pas géométriques’ or river reserves which belong to the State (sect. 3).

“Land” here includes land covered with water and things affixed on land or growing on land (sect. 2). The Act shall apply to any area constituted as a Registration District by the Minister under section 5In each District a land registry shall be maintained in which information set out in section 6 shall be kept. Section 7 concerns appointment of land registration officers.

The Proclamation shall apply to all mining operations, i.e. acts carried out to prospect, explore and mine for minerals within the territory of Eritrea. No person may carry out any mining operations without a license granted under this Proclamation. A person applying for a right must be eligible in accordance with section 5.
