The purpose of this Act is to manage national land efficiently and to contribute to the protection of property rights of people by correcting descriptions registered in official cadastral records, but inconsistent with the actual conditions of land and by converting such cadastral records embodied in paper into digital cadastral records. This Act makes provision for the establishment of the Namibian Council for Professional Land Surveyors, Technical Surveyors and Survey Technicians and for the registration of practitioners by the Registrar of the Council and regulates their qualification, professional conduct and practice.

This Regional Decree establishes the modalities of performance of municipal land control by local government. Municipal land control shall be conducted in the form of ordinary and extraordinary inspections of legal persons and individual entrepreneurs. The subject of inspection shall be checking data and information contained in the documentation related to land tenure. The scope of inspection shall be to control compliance by land tenant with compulsory legislative requirements related to land tenure with a view of prevention and suppression of unauthorized transactions with land.

This Act amends existing legislation by giving new definitions of "Minister" and other public bodies and officers and by updating certain other provisions.

This Regional Law establishes cases of allotment of plots of public or municipal land to citizens in ownership free of charge. The aforesaid land parcels shall be allotted to citizens for the following purposes: (a) individual housing construction and subsistence farming; and (b) commercial farming, horticulture, gardening and stockbreeding. Land parcels shall be allotted in accordance with land surveying documentation and once only.

This Act prohibits the carrying out of survey work (as defined) unless the person responsible for carrying out the work has given to the Director of Federal Surveys at least three months in advance, or such shorter period as the Director may allow, notice of the work to be carried out. The Act specifies duties of the Director and the person carrying out the work in relation with preparation of the survey.
