Describes a long-standing grazing dispute in northern Namibia that provides critical lessons on the challenges that people living in communal areas face to secure their land rights. Several large livestock owners illegally enclosed community rangelands to secure grazing for their own commercial cattle herds. The communities used legislation to defend their land rights: they mobilised relevant government and traditional authorities to intervene, resulting in a court order for the removal of most of the illegal cattle owners.

Investigates the processes and impact of commercialisation of land in Malawi – specifically the acquisition of huge tracts of communal lands by foreign companies and local elites for sugarcane production in Nkhotakota and Chikwawa districts. The main finding was that ‘land grabbing’ for large-scale commercial agriculture in these two districts negatively affected the livelihoods of the poor communal farmers. Report based on fieldwork in Chisumbanje seeks to understand: 1) the interest and role of the Zimbabwe Government and its contribution to the first large-scale private investments undertaken by GreenFuel in Chisumbanje; 2) the impact of the project on local communities’ land rights and livelihoods; 3) the role of the local institutions in facilitating and mediating investment, particularly on land; 4) the capacity of local and national institutions to structure a land agreement palatable to the local communities; and 5) the role of GreenFuel as the land user.

Collective ownership of agricultural land and the remains of the administrative management of rural economy have imposed considerable insecurity on the land use rights of Chinese farmers. This insecurity constrains the movement of rural people, who fear that migration will jeopardise what land use rights they do enjoy. In this paper we describe the idiosyncratic uncertainty of land use rights, and verify its influence on migration decisions, with a special focus on the duration of migration.

This publication contains the struggles of four cases presented by the aggrieved communities in Cambodia, Indonesia, and the Philippines, and deliberated by an international panel of experts during the Asian People’s Land Rights Tribunal. These cases have all exhausted various grievance mechanisms, seeking justice for the violations committed on people’s land and human rights. A set of recommendations for the communities as well as national government and international organizations, are addresses in this publication.

In Cambodia, land and natural resources occupy a central place in the production systems of peasants who represent about 80 percent of the country’s population. The development and governance of socio-ecological systems trigger considerable economic, social and environmental issues that need to be addressed urgently given the profound nature of the transformations at play in these systems across Cambodia.

Focuses on communal tenure reform developments (or lack thereof), referring to law, policy and practice in rural areas in South Africa. Shows that communal land tenure is not in a healthy state and discusses the following recent laws and policies that are symptoms of this ill health: the Communal Land Rights Act (struck down by the Constitutional Court); the Traditional Leadership and Governance Framework Act (passed in 2003); and the 2014 Communal Land Tenure ‘wagon wheel’ policy (currently in place).

The Department of Rural Development and Land Reform (DRDLR) and the Minister briefed the Committee on the performance, outcomes and challenges of the Land Rights Management Facility, presenting the Fourth Quarter 2014 report, and also touching on the Extension of security of tenure (land) Amendment Bill. It was noted that the Land Rights Management Facility (LRMF) tried to facilitate provision of specialised legal and mediation services to indigent communities and individuals faced with violations of their rights pertaining to land and livelihood.
