These Regulations define the criteria and guidelines for the designation of Special Designated Areas, which are exempted from the prohibition of acquisition of immovable property in Malta by non residents. The Minister of Finance shall issue an order designating an area as a Special Designated Area upon application by non residents who intend to acquire immovable property.

These new provisions concern further circumstances under which the Minister of Finance is entitled to issue an order designating an area as a Special Designated Area, upon application by non residents who intend to acquire immovable property.

Resolution No. 67 of 2006 amending Resolution No. 43 of 2003 concerning the appropriation of land by foreigners.

This Resolution amends article 1 of Resolution No. 43 of 2003 as follows: “allowing non Bahraini citizens, whether physical person or juridical person, to appropriate land and houses in zones A, B and C of the Kingdom as well as to appropriate tourist and investment projects after the approval of the Ministerial Committee for Public Facilities”.

International Persons Landholding (Amendment to Schedule) Order, 2007 (S.I. No. 61 of 2007).

This Order deletes and substitutes Form 1 and Form 3 of the Schedule to the International Persons Landholding Act. Form 1 concerns the application for a certificate of registration and specifies conditions for such certificate. Form 3 concerns the application for a permit to acquire immovable property.

These Regulations amend the Leases Restrictions Regulations 1977 by inserting new provisions concerning criteria to be applied by the Tribunal in a decision on any application for approval of a lease, sublease, assignment of lease or assignment of sublease to a non-resident. The criteria of assignment of lease concern citizenship of the Cook Islands, procedures regarding information to natives and consent of assembled owners resident on the island.

This Resolution amends article 1 of Resolution No. 43 of 2003 concerning the possession of lands and buildings by non Bahrainis as the following: "to allow non Bahraini whether natural or legal persons to possess lands and buildings in the following zones: (a) residence zones of category A, B and C in all the Kingdom of Bahrain; and (b) particular tourism and investment projects after the approval of the Ministerial Committee for Public Utilities".

The present Decision implements the Introductory Law relating to the Federal Act on the acquisition of land by persons abroad (Foreign Land Acquisition Introductory Law) of 26 April 1987. In particular, the Decision fixes the amount of fees to be paid for acquisition of land by persons abroad in the Canton Appenzell-Innerrhoden. The text consists of 2 articles.

Resolution No. 43 of 2003 on the appropriation of lands by foreigners.

The aim of this Resolution is to regulate the appropriation of lands by foreigners. The present Resolution is composed of 5 articles. Article 1 defines the zones and areas in which foreigners (physical or juridical persons) can appropriate lands in the Kingdom of Bahrain. Articles 2 and 3 specify the conditions and requirements for the appropriation of lands by foreigners.

This Ministerial Decree shall be applicable to land auctions regarding sale of the plots of public land or the lease right thereto and regarding the plots of non-allotted public land. Kazakhstan nationals and private legal persons shall be authorized to participate in land auctions prior registration while foreign natural and legal persons, and stateless persons shall be authorized to participate in land auctions exclusively if the aforesaid persons have the right to own or to have the right of lease of the plots of land destined for sale in accordance with land legislation.

These Regulations add to the list of qualified persons under section 45 of the Land Act, 1965, persons whose principal place of residence is in a Member State of the European Communities or other European State which is a contracting party to the European Economic Area Agreement and bodies corporate incorporated, having their registered office, central administration or principal place of business in those States. Section 45 places restrictions on vesting of interests in land not situate in a county borough, borough, urban district or town.
