Kenya’s hurried pursuit of infrastructure developments in the last decade has highlighted the need for effective environmental regulation surrounding the approval, construction and operation of new projects. One such project, the Nairobi-Thika Highway Improvement Project (NTHIP), creates fertile ground for investigation into how well Kenya’s environmental safeguards work. Transforming the road from Nairobi to Thika town into a super highway is one of Kenya’s first large-scale transportation infrastructure projects.

This report is an impact evaluation of the United States Agency for International Development’s (USAID) Justice Project, which was implemented by Landesa and its prime contractor Tetra Tech ARD, to pilot an approach for improving women’s access to justice, particularly related to women’s land rights, by enhancing the customary justice system in one target area: Ol Pusimoru sub-location, Mau Forest, Kenya.

This is our Final Report. It differs markedly from our Interim Report in structure and content layout as a direct result of the manner in which the government received our Interim Report. This change of strategy on our part, amongst other imperatives, is a full acknowledgement that the government is entitled to demand of us a Final Report of a kind that suits its purposes. However we do have a duty to report the truth as we discovered the truth through our investigations, in the context of our own experiences as well as offer best options on the way forward. 

Cutting 494.67 ha of land in Prey Toteung village of Krang Deuwy commune in Phnom Sroch district of Kampong Speu province: 232.19 ha from 2002 Forest Cover, and 262.48 ha from ELC of Grands Timber Ltd; Reclassifying 472.03 ha as state private land for granting donation of ownership to 291 [219] families; and Reserving 22.64 ha as state public land.

Cutting 441.64 of land in Prey Kaheach village of Krang Deuwy commune in Phnom Sroch district of Kampong Speu province: 224.89 ha from 2002 Forest Cover, and 216.75 ha from ELC of Grands Timber Ltd; Reclassifying 416.19 ha as state private land for granting donation of ownership to 210 families; and Reserving 25.45 ha as state public land.

Cutting 1,007.39 of land in Doung village of Krang Deuwy commune in Phnom Sroch district of Kampong Speu province: 107.89 ha from 2002 Forest Cover, and 899.50 ha from ELC of Grands Timber Ltd; Reclassifying 755.10 ha as state private land for granting donation of ownership to 325 families; and Reserving 252.29 ha as state public land.

Cutting a total land of 9,067 ha in Ponkro and Svay Chrum communes of Rolea Bphea district, Kbal Tuek, Krang Skea, Choung Mung and Toul Kpos commune of Tuek Phos district, and Svay Chok commune of Samki Meanchey district in Kampong Chhang province: 634 ha from former Sery Enterprise; 8,017 ha from economic land concession of Pheapimex; and 416 ha from 2002 Forest Cover; and Reclassifying 8,389 ha as state private land for granting donoation of ownership to 4,549 families, and Reserving 678 ha as community forest and state public land.

Cutting a total land of 1,412 ha in Chomkarchek, Sung 1 and Sung 2 villages of Sung commune in Samloth district of Battambang province: 1,400.5 ha from Bamboo forest concession of Pheapimex, and 11.5 ha from ELC of Rath Sambath; Reclassifying unspecified size of the land as state private land for granting donation of ownership to 1,000 families; and Reserving unspecified size of the land for physical infrastructure development.

Cutting 2,723.22 ha in Tar Nay and Monorom villages of Chheungkou commune in Prey Nup district of Preah Sihanouk province: 391.70 ha from 2002 Forest Cover, and 2,331.52 ha from ELC of Mong Reththy; Reclassifying unspecified size of land as state private land for donating to 1,268 families; and Reserving unspecified size of land for public interest use.
