Ce décret fixe les conditions d'obtention du titre foncier. Il comprend 46 articles répartis en 6 chapitres. Le chapitre I - dispositions générales- définit le titre foncier comme la certification officielle de la propriété immobilière; ce titre est inattacable, intangible et définitif mais il est sujet à retrait si il a été obtenu irrégulièrement.

Regional Legislative Assembly decrees to extend the sphere of application of Land Code on the regional territory from the date of validation of the present Regional Decree, except for Articles 47-51 that entry into force from the date of validation of the Regional Law on land charges. The provisions of Land Code are applicable to the relations coming into existence after the extension of Land Code to the regional territory. The Registrar of Titles shall keep a register of strata plans and shall record therein particulars of all strata plans lodged in his office for registration pursuant to the Act (reg. 3). Regulation 4 prescribes the mode of preparation of composition of strata plans. Regulation 15 provides for the registration of transfer of titles, regulation 16 for the registration of a lease, and regulation 17 for the registration of an easement or restricting covenant.

Regulations to provide for the registration of titles to land and dealings with registered land.The 136 regulations are divided into 6 Parts: First registration (I); Adjudication procedure (II); Dealings with registered land (III); Minor entries in the register (IV); Fees (V); Miscellaneous (VI). The regulations are completed by 3 Schedules. The First Schedule contains no less than 53 forms applications, notices, deeds of transfer, summons, etc.

This Decree has been enacted in order (i) to control the utilization of land in general; (ii) to settle the problems in the field of land affairs; and (iii) to review the position, tasks, and functions of the Directorate General of Agrarian Affairs, and to upgrade it to an institution which handles land affairs on a national level: the National Land Affairs Agency. This is a non-departmental government institution which is positioned under the President of the Republic.

The 7 articles regulate the National Land Cadastre. It is maintained and systematic surveys on the status of the land are conducted by the State Institute for Design "Armgiprozem" for the timely exposure, assessment, prevention and abolition of the effects of any negative phenomena (art.2,3). The Ministry of Agriculture is responsible for, inter alia, the registration of land-owners and land-users. The Decree further stipulates duties of land-owners and land-users relating to the timely and up-to-date registration in the Cadastre.

These Regulations issued in implementation of article 56 of the Land Management Law, provide for (a) registration of landownership and land-use rights; (b) the systematic surveying of lands, land-use planning, and other mechanisms to control land use; (c) procedures for the expropriation of land needed for public construction purposes; (d) restrictions on the use of agricultural land for housing purposes; and (e) criteria for the determination of the kind and amount of fines payable for offences committed under the principal Law.

According to articles 65, 66 and 67 of the Land Code (1991), National Land Cadastre should provide information, to all citizens and every kind of organization, for the safeguard of efficient land use and land protection, for the harmonization of laws on land use and landownership, for the organization of proper use of land, as well as for the qualitative description and evaluation of the land, and for other issues related to land use. Surveys on the status of the land (monitoring) are conducted in conformity with uniform standards.

Legal and natural persons using at least fifty acres of agricultural land are compelled to keep a plot register where they report every happening relative to plots of fields, gardens, orchards, grasslands and reeds. Registers also include data regarding ownership, geographical area, agrochemical, geological and climatic features of the plot. The control of plot registers is performed by county (capital) plant protection and soil conservation stations.
