Focuses on tackling land issues in post-conflict states. Root of problem is that most rural populations are little better than squatters on their own land in the eyes of the law. Remedy is to acknowledge customary land rights as equivalent to private property rights.

The well-documented threats posed by climate change are serious and potentially devastating to the global community. The geographic areas that are most susceptible to the effects of climate change, such as increased droughts and flooding, are also the regions where the majority of the world’s poor live.

This training course from the Global Land Tool Network is part of the Network’s activities on Islamic dimensions of land. In most Muslim countries, Islamic law, principles and practices make an important contribution to shaping access to land. GLTN therefore has as one of its objectives the identification and development of Islamic land tools and case studies through a cross-cultural, interdisciplinary and global process, owned by Muslims, but also including other civil society and development partners.

This paper examines the effect of climate change on pastoralist conflict in Africa. The rangelands of East Africa is particularly vulnerable to drought, which is associated with climate change. In this respect, the paper focuses its analysis on changes in resource availability contrasting cases of abundance and scarcity. The authors clarify that the role of resources is further contextualised by competing notions of property rights, and the role of the state in defining property and associated rights.

Water marketing is often cited as a means of alleviating the stresses attached to allocation of water use. Frequently, marketing is suggested in a context that implies substitution of competitive markets for the allocation based on the prior appropriation doctrine. This study examines water marketing from the perspective of a transactions cost approach to the private and broad social agreements (contracts) that support water allocation. It examines the major behavioral challenges faced by any contract, and the alternative approaches to those challenges, with respect to water allocation.

Natural resource management perceived as a search for institutions that can ensure simultaneous fulfilment of three goals: productivity (or efficiency), sustainability and equity. In this article, we study the implications of pursuing the goal of equity in the management of surface water resources for irrigation with a heuristic model incorporating a Leontief-type fixed production function. The analysis has been carried out in the backdrop of the Baliraja water distribution experiment in India.

This paper reviews the literature on economic development as it relates to indigenous people in the United States and Canada, and focuses on how institutions affect economic development of reservation and reserve economies. Evidence shows that strong property rights to reservation and reserve land and natural resources, whether communal or individual, are and always have been important determinants of productivity.

We examine the implications of the public trust doctrine in natural resource protection and conservation. A model of litigation and settlement among disputing parties suggests that the public trust doctrine introduces more costs and is more time consuming than would be the case with alternative approaches, such as the purchase of private rights through market transactions or application of eminent domain powers to reallocate the resource. Because the doctrine allows for uncompensated redistribution, it is resisted by current resource owners.

The paper presents an empirical study on the use of woody biomass for energy supply in Germany and the federal state of Brandenburg. It aims to explain the role forestry enterprises have for bioenergy provision in this area. The 'Institutions of Sustainability' framework is used as an analytical tool to investigate the role of private and public actors in these transactions, respectively, in the governance structures they are subject to. Empirical evidence was gathered by in-depth interviews with actors from forestry and bioenergy practice.

This article examines the institutionalisation of property rights by way of two case studies on biodiversity conservation in Albania and Romania. The analysis pays particular attention to local level negotiations which occur when local actors make use of concrete resources and engage in discussions about their appropriate use. In both Albania and Romania, national parks are the object of intense negotiations, as local people contest the associated restrictions on their property rights to agricultural land and forest.
