Regional Law No. 71 “On the particulars of turnover of agricultural land”.

This Regional Law establishes the particulars of turnover of agricultural land, including privatization of agricultural land pertaining to public and municipal property. It determines that minimum land area of consolidated agricultural land plot shall be two hectares, while minimum land area of consolidated agricultural land plot in case of irrigation by stationary sprinklers or drained land shall be no less than 50 hectares and in case of irrigation by mobile sprinklers shall be no less than 10 hectares.

This Regional Law regulates the issues of allotment free of charge to citizens in ownership of land plots pertaining to state and municipal property. The aforesaid allotment shall be performed once only to citizens that had in actual use, before entry into force of the Land Code, the aforesaid land plots for the purpose individual residential housing construction, smallholding and gardening without legal registration of land rights in due course. This Regional Law classifies categories of citizens having the right to land allotment.

Part I deals with (application for) customary land rights. It specifies the maximum size of land that may be held under customary land right and specifies particulars pertaining to allocation of customary land right.

A comprehensive research report covers the literature, includes a large survey of farm households throughout Ethiopia, and surveys the opinions of professionals. Land tenure is now a hotly debated issue; land scarcity and degradation are serious. Tenure security is seen as more important than the form of ownership. Almost three-quarters of farmers surveyed fear future distributions of land. Government is afraid that moving from state to private ownership will lead to massive evictions through distress sales, but over 90% farmers said they would not sell their land if they could.

The Act provides for the general principles of civil law of Estonia. Notably, it defines the concepts of movable and immovable property defining the latter as a delimited part of land (plot of land). The essential parts of an immovable are the things permanently attached to it, such as buildings, standing crop, other vegetation and unharvested fruit.

This paper discusses the development of a new Land Law in Mozambique 1 , under the leadership of the Technical Secretariat (TS) of the Inter-ministerial Commission for the Revision of Land Legislation (popularly known as ‘the Land Commission’). The TS began work on the new law in August 1995 after first formulating a new National Land Policy. The National Assembly approved the law two years later. Regulations and other instruments needed to implement it were completed in December 1999.
