Regional Law No. 386 “On state protection of the objects of cultural heritage”.

This Regional Law regulates relations in the sphere of conservation, protection and management of the objects of cultural heritage classified as immovable property, and land-use planning related to the objects of cultural heritage. Regional Government shall establish rates on land taxes applicable to land parcels on which objects of cultural heritage are located, protection regime and boundaries of protected areas related to the objects of cultural heritage.

This Regional Law regulates relations in the sphere of protection, management and reproduction of urban forests with a view of creation of favourable environment for the population. The role of urban forests shall be as follows: (a) recreational, ecological, aesthetic, sanitary and other protection functions; (b) tourism and sport. In case of planning of economic activities on areas under urban forests reforestation and forest conservation arrangements shall be envisaged.

This Act, among other things, recognizes the Minerals Management Board as established by section 214 of the Constitution and provides rules relative to exploration and exploitation of minerals in Swaziland. The Government may declare any area as a protected watershed area and the Watershed Conservation Officer may take within the area the measures established by the present Act for the purpose of soil and watershed conservation (e.g. construction and maintenance of waterworks, afforestation, planting of grasses or other vegetation, protection of forests, cultivation of crops and fruits, maintenance of the fertility of the soil, etc.).

This Act provides for the management of public gardens, i.e. any land vested in the Commissioner of Lands, and designated by him or any entity acting on his behalf for use as public garden. It also prohibits various activities in such gardens and provides for seizure and impounding of stray animals. prohibited activities include: picking of fruits, plants or flowers; destroying of trees; and injuring of animals.

Por la presente Ley se declara al territorio indígena y Parque Nacional Isiboro Sécure - TIPNIS patrimonio sociocultural y natural, zona de preservación ecológica, reproducción histórica y hábitat de los pueblos indígenas Chimán, Yuracaré y Mojeño-trinitario, cuya protección y conservación son de interés primordial del Estado Plurinacional de Bolivia. El mencionado territorio queda declarado como intangible y en consecuencia se prohíben los asentamientos y ocupaciones de hecho realizadas por personas ajenas a la titularidad del territorio indígena en cuestión.

Article 14 shall be amended to add the following wording: “Land parcels within the boundaries containing objects of cultural heritage of regional significance shall be classifies as protected areas by decision of the Regional Administration that establishes the modalities of land tenure and protection thereof”.
