This Ministerial Decree regulates keeping of the Register of peasant farms and the modalities of registration thereof. The Register shall be public and it shall contain data related to the establishment re-organization. The scope of the Register shall be to collect and store data and information related to the functioning of peasant farms. The Register shall be kept in the official language but its contents can be translated in other languages. Data regarding land area must be recorded up to a hundredth of hectare.

Land in the Republic of Tajikistan is exclusive state property, and the state guarantees its efficient use in the interests of the population. One of the main ways of the agricultural development of the country is the improvement of the state of ameliorated land, organization of complete, rational and efficient use of available land and development of new lands. The Regulation consists of 18 Sections. Section 1 is a foreword. Section 2 regards land resources. Section 3 regards arable land. Section 4 regards perennial plants’ land. Section 5 regards hay-making and grazing land.

These Regulations, which apply to England, are made pursuant to section 98 of the Environment Act 1995, and provide for a grant to be made to any person who enters into an agreement with the Secretary of State requiring him to carry out activities which are conducive to a specified purpose on land in which he has an interest. The specified purposes are the conservation of the natural beauty or amenity of the countryside and the promotion of the enjoyment of the countryside by the public. Four pilot areas have been designated to reflect different uses of agricultural land in England.

The purpose of these Regulations is to establish and prescribe minimum standards for soil quality, to establish minimum standards for the management quality of soil intended for agricultural use, the establishment of criteria and procedures for the measurement and determination of soil quality and to issue measures and guidelines for soil management. The standards are prescribed in the First Schedule. The Second Schedule contains the guidelines for the management of fragile or particular soils.

These Regulations provide for conditions, to which the right of occupancy as defined in the Land Act, 1991 is subject. The Commissioner of Lands may impose those conditions pursuant to regulation 3, but they shall not be inconsistent with the Act. Other conditions are specified by these Regulations, such as demarcation of boundaries, protection of beacons, application for building permits on urban or "peri-urban" land, etc. Regulation 7 specified conditions of use of agricultural land held in occupancy, regarding cultivation. Regulation 8 concerns the right of occupancy for pastoral uses.

The Department of Agriculture and Rural Development has the power to designate areas as environmentally sensitive areas where it appears to it particularly desirable to conserve, protect or enhance environmental features in those areas by the maintenance or adoption of particular agricultural methods.

The Degree, aiming at a better protection of waters and water basins from nitrate pollution, completes paragraphs a and b, article 2 of Ministerial Joint Decree No. 19652/1906/1999 by adding to the Catalogue of vulnerable zones, three more areas: Thessalonica, Strymonas (Struma) river basin and Arta-Preveza. The delimitation of these areas are pinpointed on maps attached to this Decree.

This Decree requires producers of agricultural commodities to pay a single land tax in place of all other taxes (except import taxes). They shall continue to pay state dues and licensing fees. Forest management, fishing and hunting enterprises shall not be considered producers of agricultural commodities for the purposes of this Decree. Agricultural land allotted on condition of ownership, tenancy or lease shall be subject to taxation. Data on land area, location, soil quality and other characteristics shall be taken from the land cadastre.

Joint Regulation No. 1345 of the Ministry of Justice and No. 564 of the Central Bank on extending credit to farms secured by land lease rights.

This Joint Regulation regulates commercial bank loans to farming enterprises secured by land lease rights. Credit shall be extended on condition of its recovery, security and intended use. Commercial banks shall extend credit on a contractual basis and shall have as collateral the rights to land leases. As such, the lease in question must have a term that extends at least five years beyond the loan repayment date.

This Joint Regulation establishes the modalities for assigning values to long-term land leases held by farmers to ensure credit recovery by commercial banks. The Regulation applies only to land transferred to commercial banks as security for loans granted to farmers. Valuation of such leases shall be calculated as the average net profit for a land unit for the previous three years. If a farm has been operating for fewer than three years, the amount shall be calculated based on a similar plot of land located in the same area.

This Ministerial Decree validates the maximum size for plots of agricultural land within a single administrative unit (city) that may be allotted: in ownership to citizens of Kazakhstan for farming; to non-public legal persons for agricultural production; and in temporary land tenure to foreigners, stateless persons and foreign legal persons for commercial farming.
