The Community Land Act of 2016 provides a legal basis for protection, recognition and registration of community lands andhas provisions for management and administration of the land by the communities themselves. However, implementation of the act has been slower than anticipated. This is despite the current  heightened investment interests in community lands for mega development projects.

Ces textes sont issus des journées d’études de juillet 2018 organisées par le Comité technique « Foncier & développement » dans le cadre du chantier de réflexion collective « Systèmes agraires et accès des jeunes à la terre ».

En Côte d’Ivoire comme dans d’autres pays africain, le pluralisme juridique est l’origine d’une crise de la légalité et de crispations sociales. L’accès à la terre est emblématique des difficultés et des différends qui peuvent naître de la coexistence, issue de la colonisation, d’une pluralité de modes de normativité étatique et coutumier en jeu sur un même territoire.

Presents an overview of 15 countries in Eastern and Southern Africa where land and natural resource tenure initiatives have been implemented over several decades by governments;civil society;the private sector and other developmental organisations. Features challenges;strategies and tools for increasing poor people’s access to secure land and natural resources. Allows for comparison between the selected countries to help practitioners;students and researchers to better grasp the complexities of dealing with land and natural resource tenure in these countries.

Since the arrival of multinational agribusiness company SOCFIN in 2011 as part of a large-scale investment in palm oil in the Southern Province of Sierra Leone;social conflict has raged in the Malen Chiefdom. SOCFIN is controlled by a Belgian businessman (Hubert Fabri) and the French group Bolloré;which has developed a business empire in many parts of Africa. This report found that affected communities who have lost access to and control over their land have been exposed to serious human rights violations and abuses since 2011.

This detailed evaluation of the Governance and Justice (GJ) Program (formerly Governance, Security and Justice - GSJ) takes stock of progress in programme delivery and reflects on potential modifications, both programmatically and institutionally, that can be brought to the GJ Program design going forward. The evaluation found that the GJ Program has been highly effective in producing key outputs. Project innovations are well positioned for use, with cohort-based projects more relevant to communities, policymakers, NGOs and the private sector.

Mailo is a unique tenure system in central Uganda. It is divided into three parts: Kabaka’s Mailo, Official Mailo and Private Mailo. Private Mailo belongs to an individual, so-called landowner and it can be sold, subdivided or transmitted. Conflicts on private Mailo can occur between landowners & tenants, tenants & tenants, and landowners & landowners. A key challenge is that there is a lack of knowledge and transparency on land rights on both sides.
