Decree No.2418-XII of the Supreme Soviet regarding validation of the law regarding the right to land property.

The Supreme Soviet decrees as follows: 1). to put into effect the law regarding the right to land property from the 1st of September 1993; 2). till the conformation of the legislation of the Republic of Belarus to the law regarding the right to land property the effective legislative acts must be used to the extent that they do not contradict the aforesaid law; 3).

The present Law establishes the form of land ownership, the base of origin, changes and cessation of land ownership, regulates the order of realization of the rights and the duties of landowners. The land relationship connected with privatisation of buildings, structures, and constructions belonging to state property are regulated by special acts related to land legislation. Land ownership in the Republic of Belarus is present in the forms of state and private ownership.

Lease is temporary fee-based possession, use and management on contractual basis of land, other natural resources and property necessary to lessee for carrying out autonomously economic and other activity. The document consists of 4 sections that contain 32 articles. Section 1 (arts. 1-19) lays down general provisions. Section 2 (arts. 20-28) regards lease of enterprises. Section 3 (arts. 29-30) regards lease of property by citizens. Section 4 (arts. 31-32) regards dispute settlement and establishes liability of the subjects of lease relations.

Mining Proclamation No.52/1993.

This Proclamation lays down the regulatory framework for mining operations in Ethiopia. It defines the principles of sound development of the mining sector and defines the criteria for eligibility for mining rights, i.e. a prospecting licence, an exploration licence, an artisanal mining licence, a small-scale mining licence and a large-scale mining licence. A mining licence shall give the right to abstract, in limited quantities, mineral and geothermal water.Furthermore, the Proclamation defines the rights and duties of licence holders and provides for financial matters and administration.

Agricultural Tile Drainage Installation Act (R.S.O. 1990, c. A.14).

The present Act lays down provisions relating to the construction of drainage works, that is a drainage system constructed of tile, pipe or tubing of any material beneath the surface of agricultural land, including integral inlets and outlets, to improve the productivity of the land drained. According to section 2 no person shall carry on the business of installing a drainage work unless he or she is the holder of a licence released the Director.

The Act provides with respect to the amount of compensation payable for damage to agricultural crops and fruit trees. Where the damage amounts to total destruction, the compensation shall be calculated at the rates set out in the Schedule. If the damage is partial, the compensation shall be calculated on that proportion of the amount for total destruction directly attributable to the damage as may be determined by assessors appointed by the parties within four days of the occurrence of the damage.

This Law establishes the procedure for leasing land to natural and legal persons of the Republic of Lithuania and foreign states as well as to joint ventures and firms with foreign capital, and regulates the relations between the lessee and the lessor. The Law describes in article 2 the concept of lease, prescribes in article 3 the form of a lease contracts, whereas article 4 prescribes the contents of a lease contract. Article 6 provides for the leasing of state-owned land by competitive bidding. Lessees shall meet requirements set out in article 7.

Mining Proclamation No. 68/1995.

The Proclamation shall apply to all mining operations, i.e. acts carried out to prospect, explore and mine for minerals within the territory of Eritrea. No person may carry out any mining operations without a license granted under this Proclamation. A person applying for a right must be eligible in accordance with section 5. Certain criteria do not apply to persons wishing to acquire an Artisanal mining right (as defined in section 2). Any Eritrean may prospect without a license on land not already subject to an existing license or application for a license.

Agricultural Tenancies Act 1995 (Chapter 8).

An Act to make provision for farm business tenancies which begin after 1 September 1995. Section 4 excludes in part the Agricultural Holding Act, 1986 to tenancies covered by the present Act. Sections 5 to 7 provide rules for the termination of tenancies. Tenancies continuing for more than two years shall afterwards continue from year to year unless terminated by notice (sect. 5). Section 8 recognizes the right of a tenant to remove buildings and fixtures.

La presente Ley aprueba el Convenio número 169 sobre pueblos indígenas y tribales en países independientes, adoptado por la 76a. reunión de la Conferencia General de la OIT, Ginebra 1989. Los gobiernos deberán asumir la responsabilidad de desarrollar, con la participación de los pueblos interesados, una acción coordinada y sistemática con miras a proteger los derechos de esos pueblos y a garantizar el respeto de su integridad.
