The Act consists of 43 sections divided into 6 Parts: Preliminary (I); Central administration (II); Development Plans (III); Control of development of land and permission for development (VI); Subdivisions (V); Supplemental (VI).The Minister shall be responsible for a comprehensive policy with respect to use and development of all land in Botswana and in accordance with Development Plans made under Part III (sect. 3). The Minister may declare Planning Areas under section 4 and provisions of this Act shall apply to such areas. A Town and Country Planning Board is established under section 5. The Board shall determine permission for the development of land and advise the Minister. The Minister shall carry out as soon as possible a survey in a Planning Area and prepare a Development Plan (sects. 6 to 8). Section 11 concerns conditions for permission of development, whereas section 16 concerns the power to grant such permission. Section 18 sets out an enforcement procedure with regard to illegal development. Section 22 concerns transfer of planning functions. The Minister may issue a Tree Preservation Order for the preservation of any tree, trees or woodland in accordance with section 23. The First Schedule sets out rules regarding constitution and procedures of the Board. The Second Schedule lists matters for which provision may be made in Development Plans.
