This Regulation provides the definition of topsoil, which is “soil containing 0.9 percent or more organic carbon, as determined by the Walkley and Black method, and sand, silt and clay”. It specifies the procedure and requirements for obtaining a permit for the removal from site or he move of topsoil as well as for its transportation. Permits have to be accompanied by a rehabilitation plan for topsoil removal sites; among others such plan must cover the removal of all equipment, buildings and structures placed or erected on the site for the purpose of topsoil removal, clearing of all debris from the site, and management of the site in order to ensure that the grass or vegetation is maintained for a period of at least two years.
