This Act makes provision for the judgement of claims in land, for the adjudication and registration of title in land and various other related matters. The Act consists of 99 sections divided into 6 Chapters.This Act shall apply to land in any district, area or place in Kenya as the President may, by Proclamation published in the Gazette, determine. For purposes of adjudication and registration of title, the President may appoint a Recorder of Titles and there is established the Land Registration Court. The Recorder of Titles shall act as the presiding judge of the Court and the shall have jurisdiction in all claims made under this Act relating to immovable property situated in an area to which this Act applies. The Commissioner of Lands, on behalf of the Government, and any person aggrieved by any final judgment of the Recorder of Titles, may appeal to the High Court. A Certificate of title shall be granted by the Recorder of Titles to a successful claimant. This may be: (a) a certificate of ownership in form B in the First Schedule; (b) a certificate of mortgage in form C in the First Schedule; or (c) a certificate of interest in form D in the First Schedule. The Act further provides for the procedures of adjudication, for specified legal actions and effects and for the registration of documents. It also defines penalties and prescribes offences.
